Recommended Action
  1. Approve agreement with David E. Thorburn and Kate M. Thorburn, Trustees of the Thorburn 1993 Trust dated February 5, 1993 for $13,700 for a road and utility easement for the County Road 29 Bridge Replacement Project over Dry Slough; and
     
  2. Authorize the Director of Public Works to sign agreement and approve payment, open escrow, accept the easement, and record the deed once the signed deed has been received and escrow has closed.

Reason for Recommended Action/Background
A permanent road and utility construction easement is required on this property for the County Road (CR) 29 Bridge Replacement project over Dry Slough.  Pattison and Associates, Inc., a property acquisition consultant, provided the appraisal for the acquisition, and an accompanying independent review appraisal, to determine the value of the property.  County staff worked with the property owners to come to a mutually acceptable agreement for the purchase.

Background
The CR 29 Bridge over Dry Slough (22C-117) is located approximately 0.75 mile west of CR 98. The existing 20-foot wide bridge built in 1930 was classified by Caltrans as functionally obsolete with a sufficiency rating of 39.6 of 100.  The new bridge will comply with the current standard and will be 32-feet wide and comprised of two 12-foot lanes and four-foot shoulders. During construction the road will be closed and will detour traffic to CR 95 and CR 98. In compliance with the California Environmental Quality Act (CEQA), a mitigated negative declaration for this project was adopted by the Board of Supervisors on November 9, 2016.  A National Environmental Protection Act (NEPA) categorical exclusion was approved on March 9, 2017.
 
The temporary construction easement is needed for construction equipment crossing the slough during the bridge construction. 
 
In accordance with federal requirements for property acquisition, just compensation was established by the County based on the approved appraisal and an offer was delivered to the owner on April 18, 2019.  Since that time, staff has worked with the property owners to reach an acceptable agreement as shown in the attached Agreement (Att. B).
 
Once the County takes possession of the easements on the Thorburn right of way (June 1, 2020), AT&T will be able to relocate their existing facilities that are currently attached to bridge.  AT&T relocation is anticipated to occur in the summer or fall of 2020.  Relocation of PG&E facilities (power pole) will occur after the necessary easements are acquired.  Provided easements can be acquired and utilities can be relocated by the winter of 2020, construction of the bridge can occur in the summer of 2021.

The approved FY 2019-20 road fund budget includes sufficient funds for right of way acquisition for this project.  The total cost will be reimbursed by federal transportation funds at a rate of 100%.
