Adopt Resolution of Acceptance of Parcel Map No. 5183 to divide a commercially zoned parcel into seven separate parcels at the intersection of County Road 8 and 99W in Dunnigan. (No general fund impact) (Echiburu/Tschudin)
Recommended Action
  1. Adopt the Addendum to Mitigated Negative Declaration (SCH#200003125) as the appropriate level of environmental review under the California Environmental Quality Act (CEQA) (Attachment B);
     
  2. Adopt the Resolution of Acceptance of Parcel Map No. 5183 (Attachment C);
     
  3. Instruct the Clerk of the Board of Supervisors to verify that the Tax Collector has signed the map; and
     
  4. Authorize the Clerk of the Board of Supervisors to sign and transmit Parcel Map No. 5183 (Attachment D) to the County Clerk-Recorder for filing.

Reason for Recommended Action/Background
On November 14, 2019, the Planning Commission approved a Tentative Parcel Map (TPM) request to divide an existing 9.77-acre parcel into seven separate parcels so that the applicant can finance the continued development of a project previously approved by the Board of Supervisors in June of 2006 (Zone File No. 99-082), which provided for future highway serving commercial uses. This parcel is located at  the intersection of County Road 8 and 99W, in Dunnigan, on the east side of Interstate-5 (APN 052-130-004).  Zone File No. 99-082 was subject to 22 Conditions of Approval and a Mitigation Measure Monitoring Program.

The conditions of approval and mitigation measures included in Zone File No. 99-082 required installation of a number of on- and off-site improvements to road facilities and infrastructure to serve the future development. The applicant twice submitted applications for minor revisions to the original project approval's site configuration, but no new uses were added and the slight modifications were deemed consistent with the original project approval. The applicant satisfied the conditions related to storm drainage, water service, and waste water discharge, in addition to the roadway improvements, and is currently in the process of developing the site with the approved highway serving commercial uses. When complete, the project site will contain one Arco gas station and convenience store, a Burger King restaurant and drive-through, a Taco Bell restaurant and drive-through,a Starbucks and a Subway and drive-through, and a future 60-room hotel and commercial use that do not yet have submitted plans. 

Due to Yolo County's commitment to agricultural preservation, there is a limited availability of commercially zoned land in the unincorporated areas. The purpose of the Highway Services Commercial (C-H) Zone is to provide for retail, commercial services, transient residential, and other uses common to parcels in the vicinity of major roadways. Staff support approval of Tentative Parcel Map No. 5183 because it will allow the applicant to continue his efforts to develop restaurants, lodging, and services at an appropriate location, as approved under Zone File No. 99-082, and subsequently confirmed under Zone Files 2006-065 and 2016-0027, for both local residents and travelers utilizing the Intestate-5 traffic corridor. An Addendum to a previously adopted Mitigated Negative Declaration (SCH#200003125) has been prepared. Collaborations (including Board advisory groups and external partner agencies)
The Dunnigan Citizens Advisory Committee heard the project as an action item at their meeting on September 18, 2019, and voted unanimously to recommend the project for approval. The Yolo County Planning Commission voted unanimously to approve the Tentative Parcel Map request at the November 14, 2019, Planning Commission hearing.
