Reason for Recommended Action/Background |
The purpose of this ordinance is to amend the Gravel Mining Fee Ordinance in Title 10, Chapter 11 of the Yolo County Code of Ordinances to clarify the per ton fee amounts following the annual four percent increases. Specifically, a schedule of fee increases -- based on the fee amounts and formulas established by the Board of Supervisors in actions taken in 2013 and 2014 -- is being proposed to be added to Section 10-11.01(c) of the Gravel Mining Fee Ordinance.
The Gravel Mining Fee Ordinance was last modified in December 2019 as a part of the comprehensive update to the plans and ordinances that comprise the Cache Creek Area Plan ("CCAP Update"). The proposed amendments described above should have been included in the suite of modifications during the CCAP Update, but were inadvertently excluded.
Adoption of this "clean up" ordinance makes no substantive change to the ordinance or the gravel mining fees; it simply adds a schedule of fee increases based on the fee amounts and formulas established by prior Board action.
This action is exempt from CEQA under CEQA Guidelines Section 15061(b)(3) which states in relevant part: "...CEQA applies only to projects which have the potential for causing a significant effect on the environment. Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA." The Cache Creek Area Plan Update, which included the proposed modifications to the Gravel Mining Fee Ordinance, was the subject of a Final EIR (SCH#2017052069) certified December 17, 2019. Clarifying the fee ordinance will not increase or change any mining activities and thus there is no possibility the activity in question may have a significant effect on the environment. |
