Adopt Resolution of Acceptance of Parcel Map No. 5135 to create two parcels of approximately 0.14-acres for a property, currently vacant, that is located at 17868 Railroad Street in Madison (APN 049-448-005).  (No general fund impact) (Echiburu/Tschudin)
Recommended Action
  1. Adopt Resolution of Acceptance of Parcel Map No. 5135 (Attachment B);
     
  2. Adopt the Negative Declaration as the appropriate level of environmental review in accordance with the California Environmental Quality Act (CEQA) and CEQA Guidelines, (Attachment C);
     
  3. Instruct the Clerk of the Board of Supervisors to verify that the Tax Collector has signed the map; and
     
  4. Authorize the Clerk of the Board of Supervisors to sign and transmit Parcel Map No. 5135 (Attachment D) to the County Clerk-Recorder for filing.

Reason for Recommended Action/Background
The property is currently owned by Roberto and Noel Chavez and the proposed split will allow the owners to sell the two lots with the assumption that the home sites will be developed with duplex residences. The 0.28-acre property is one of the few remaining vacant parcels in Madison, and approval of Parcel Map No. 5135 would allow for infill development and help provide for a variety of housing options in the unincorporated area of Yolo County.

The approximately 0.28-acre low density residential (R-L) zoned parcel is undeveloped. Project approval would divide the parcel into two 0.14-acre (6,002 square feet) lots, that would satisfy the minimum parcel size for newly created R-L zoned parcels. Per Table 8-2.505, Development Requirements in Residential Zones, the minimum lot area for low density residential parcels is 3,500 square feet if connections to public water and sewer services are available (Article 5, Chapter 2 of Title 8, Yolo County Code). Madison Community Services District confirmed it can provide water and sewer services to both parcels, so the resultant parcels would satisfy the minimum lot area for low density residential parcels. The allowed density on R-L zoned parcels is between 1.0 – 9.9 dwelling units per acre, which would facilitate duplex development.

On April 12, 2018, the Planning Commission approved a Tentative Parcel Map (TPM) request from the applicant to divide a 0.28-acre low density residential parcel into two separate legal lots (“Parcel 1” and “Parcel 2”).  The purpose of the Parcel Map is to enhance existing and future residential opportunities. The applicant has satisfied all conditions placed on Tentative Parcel Map No. 5135 and has submitted the final Parcel Map for acceptance by the Board of Supervisors. The TPM meets the 3,500 square foot minimum parcel size requirement and the intent of policies in the 2030 Countywide General Plan that govern the division of low density residential lands. The parcel split supports future infill development in an existing unincorporated community and provides for a diversification of housing options, while protecting agricultural land in the County from encroachment of urban uses.

The Planning Commission approved the Tentative Parcel Map on April 12, 2018. The office of the County Counsel has reviewed and approved the Parcel Map Acceptance Resolution as to form.
