Reason for Recommended Action/Background
During normal operations, the Yolo County Central Landfill (Landfill) generates leachate and other liquid waste. The landfill also accepts other liquid wastes such as septage, chemical toilet wastes and industrial wastewater generated in unincorporated areas.  These liquid wastes are stored and treated in the landfill's surface impoundments and disposed of by evaporation.  Historically, during heavy rainy seasons, the volume of liquid waste has occasionally exceeded the evaporative capacity of the surface impoundments and required offsite disposal of some liquid waste.  Since 1991, the Landfill has discharged its excess liquid waste to the adjacent Wastewater Treatment Plant (WWTP) operated by the City of Davis (City) for treatment and disposal.
 
The City's Sewers and Sewage Disposal Ordinance authorizes special contracts between the City and any industrial user, whereby the City may accept for treatment industrial waste at a charge fixed by special contract provided the waste does not violate any pretreatment standard.  The amount charged by the City pursuant to the special contract should reflect, as close as is reasonably practicable, the cost the City incurs in providing, operating, and maintaining the facilities serving the contracting industrial user. This agreement establishes a special industrial sewer rate for the City’s treatment and disposal of the Landfill’s wastewater at the WWTP.
 
Under the proposed agreement, the Landfill agrees to pay to the City a rate of $4.72 per 100 cubic foot of wastewater discharged by the Landfill to the WWTP (“Contracted Rate”). The Contracted Rate is based upon the City’s cost of operating and maintaining the WWTP, which comprises approximately 70% of the standard sewer rate for industrial discharges because the Landfill does not use the City’s collection system to transport its leachate to the WWTP. 
 
An amendment to extend this contract was previously brought before the Board on September 25, 2018. However, the agreement that was provided to the Board for execution was not the final agreement; the version preceding the final version was inadvertently attached.  Therefore, IWM staff is returning at this time with the final agreement that was negotiated between County and City of Davis staff.

The current Discharge Permit has an expiration date of February 28, 2019. However, the City of Davis has granted an extension through August 31, 2019.
Collaborations (including Board advisory groups and external partner agencies)
County Landfill staff and City Wastewater Treatment Plant staff worked together to prepare the agreement. The agreement was approved as to form by County Counsel and the Davis City Council approved a resolution authorizing the Public Works Director to execute special contracts to set rates for industrial users discharging to the City’s Wastewater Treatment Plant.

There was not a competitive bid process because of the contiguous location of the Davis Treatment Plan.

Landfill staff estimates a $850,000 cost for the five-year term of the agreement, and has budgeted sufficient funds in fiscal year 2018-19 and 2019-20.

Under the agreement the Landfill agrees to pay to the City a rate of $4.72 per 100 cubic foot of wastewater discharged by the County to the Waste Water Treatment Plant (“Contracted Rate”). The Contracted Rate is based upon the City’s cost of operating and maintaining the WWTP, which comprises approximately 70% of the standard sewer rate for industrial discharges because the County does not use the City’s collection system to transport its liquid waste to the WWTP. Discharge volume is measured by existing meters as specified in the Discharge Permit.
