Recommended Action
  1. Adopt the plans and specifications for the construction of a food depackager system;
     
  2. Authorize the Interim Director, Division of Integrated Waste Management to sign the Notice to Contractors;
     
  3. Authorize the Division of Integrated Waste Management to advertise for competitive bids;
     
  4. Authorize the Interim Director, Division of Integrated Waste Management to execute a construction contract with the lowest responsive bidder, provided the contract amount does not exceed available funds, or to reject all bids; and
     
  5. Authorize the Interim Director, Division of Integrated Waste Management to approve all construction change orders, provided the contract amount does not exceed available funds for the project.

Reason for Recommended Action/Background

These actions will allow the Department to solicit competitive bids, expedite the contract award and promptly proceed with construction.


Background

California has a statewide goal to divert 75 percent of waste from the landfill by 2020. In February 2007, the California Department of Resources Recycling and Recovery (CalRecycle) adopted Strategic Directive (SD) 6.1, which calls for a 50 percent reduction in the amount of organics being disposed in the landfills by 2020. Organic waste makes up approximately one third of the 35 million tons of waste that is currently landfilled in California. To aid in meeting the state wide 75 percent goal, Assembly Bill 1826 was passed in September 2014 requiring businesses, including state agencies, which generate certain amounts of organic waste per week to have organic waste recycling programs on or after April 1, 2016. To meet these goals, the landfill has implemented a three-part strategy: having an organic waste transfer facility, an anaerobic composter facility, and an in-vessel digester (liquid digester).

The Division of Integrated Waste Management has designed an in-vessel digester (liquid digester) to further divert organic waste from being disposed of in the landfill and surface impoundments. The in-vessel digester will also generate methane for electricity from the diverted organic waste. To help further increase the amount of food waste diversion, methane produced for electricity, and marketable compost by both the anaerobic composter facility and the in-vessel digester; a food depackager system has been designed. The food depackager system separates the usable organic portion of in-coming waste from inorganic packaging/waste which prevents the waste from being utilized directly by the anaerobic composter facility or the in-vessel digester. At the moment there are not a lot of projects in the immediate area that can recycle or beneficially utilize packaged food waste, as such construction of a food depackager system can allow the landfill to obtain waste flow agreements with waste haulers, companies, and cities before other competitors can. The food depackager units all have about a 6-month manufacturing lead time, so ordering one now will ensure that the landfill division can obtain these aforementioned agreements sooner.

It is anticipated that the manufacturing of the equipment for the food depackager system would start near the beginning of August 2018 and installation would start in January 2019, and will finish by the end of January 2019.

Competitive Bid Process

Project will be advertised on Bidsync.com for competitive bidding. The competitive bid process will be completed in accordance with State law. Bids will be opened and read publicly at the Department of Community Services-Division of Integrated Waste Management. A contract may only be awarded to the lowest responsive and responsible bidder.

Food depackager system will be paid by the Sanitation Enterprise Fund, which is funded through the tipping fees collected at the landfill. There will not be an impact to the general fund. The total budgeted amount for FY 18-19 for construction of the in-vessel digester and the food depackager system, including contingency is $1,580,000. The engineer's estimate including contingency for construction of the food depackager system is $580,000.
