Reason for Recommended Action/Background
On or after July 1, 2017:
 
The Mental Health Plan in the county of residence, upon presumptive transfer, is required to assume responsibility for the authorization and provision of specialty mental health services and payment for services. (W&I Code 14717.1(f)).
 
Yolo County Health and Human Services Agency (HHSA) seeks to ensure that children and youth in foster care who are placed outside their county of original jurisdiction (home county) have access to Specialty Mental Health Services (SMHS) in a timely manner based on their individual needs, consistent with Early and Periodic Screening Diagnostic and Treatment requirements.  In order to comply with Assembly Bill 1299 (AB 1299) Ridley-Thomas, Chapter 603, Statute 2016, Yolo County HHSA is required to promptly transfer the responsibility for service provision and payment of Specialty Mental Health Services to the county in which the foster child resides.
 
The County in which the foster child receives treatment can bill for reimbursement of treatment costs.  Medi-Cal reimbursement for Specialty Mental Health Services is typically paid at 50% of total treatment cost.  Yolo County HHSA is responsible for reimbursing any county in which a Yolo County foster child receives SMHS for any unreimbursed costs for treatment services (typically the remaining 50%).  This Resolution will allow the Health and Human Services Agency to compensate other counties, without unique contracts with every county, to ensure the prompt payment for treatment of Yolo County foster children.
 
In order to ensure the prompt transfer and treatment of Yolo County foster children, and in compliance with AB 1299 requirements, this request is to establish a Board Resolution to allow the Health and Human Services Agency to reimburse any county for unreimbursed costs for Specialty Mental Health Services provided to any Yolo County foster child, until such time that AB 1299 is modified or repealed.
