Recommended Action
  1. Approve Yolo County Health and Human Services Agency authorization (Attachment A) for release of future unencumbered funds from the Mental Health Services Act Housing Loan Program Fund; and
     
  2. Approve Yolo County Health and Human Services Agency authorization (Attachment B) for release of existing unencumbered funds from the Mental Health Services Act Housing Loan Program Fund.

Reason for Recommended Action/Background
In 2008, Yolo County was awarded approximately $3.1 million dollars as Mental Health Services Act Housing Funds, to be administered by the California Housing Finance Agency.  In October of 2015, Yolo County Mental Health Services Act filed its Supportive Services Plan with the California Housing Finance Agency, formalizing an agreement with developers Mercy Housing California and New Hope Community Development Corporation to build an 80-unit complex at 180 W. Beamer Street, Woodland. According to the agreement, 20 of the 80 units would be designated for clients served by the Mental Health Services Act, specifically, those who were seriously mentally ill and had recently experienced homelessness.  $3.1 million of Yolo County’s Mental Health Services Act Housing funds were then encumbered for this project.  Demolition of the old Yolo General Hospital building at 180 W. Beamer Street is complete and construction of the housing complex should begin in late spring/early summer.

On May 30, 2016, the interagency agreement between the Department of Health Care Services and the California Housing Finance Authority to jointly administer the Mental Health Services Act Housing Program expired, and any remaining unencumbered MHSA funds must now be released to counties.

At this time, there is $22,785.75 in remaining unencumbered funds. In order for remaining unencumbered funds to be released, counties are required to submit certain forms of instruction to the Department of Health Care Services on how to handle present and future unencumbered or disencumbered funds. These forms (Attachments A and B) must be signed by the Mental Health Director and approved by the Board of Supervisors.

Mental Health Director Karen Larsen, on behalf of MHSA, requests Board of Supervisors approval of these documents, with evidence thereof to be submitted with the documents to the CA Department of Health Care Services.
To this end, the Yolo County Mental Health Director, Karen Larsen has completed the following forms:
  • ATTACHMENT A: MHSA HOUSING LOAN PROGRAM ONGOING ANNUAL MHSA FUND RELEASE AUTHORIZATION FOR FUTURE UNENCUMBERED FUNDS. This form allows for the release to Yolo County Mental Health Services Act of deposits of unencumbered Housing funds, deposits of disencumbered Housing funds, residual receipt loan payments, and accrued interest.  The source of any future unencumbered fund deposits for Yolo County would likely be from loan payments received on 180 W. Beamer financing.
  • ATTACHMENT B: MHSA HOUSING LOAN PROGRAM FUND RELEASE AUTHORIZATION FOR EXISTING UNENCUMBERED FUNDS.  This form allows for the release to Yolo County Mental Health Services Act of unencumbered funds on deposit with the California Housing Finance Authority as of May 31, 2016 (plus any interest accrued). At this time, $22,785.75 represents the remaining balance after $3.1 Million was encumbered for 180 W. Beamer.
According to the Department of Health Care Services, the funds they release to Yolo County shall be used to provide housing assistance to the Mental Health Services Act target population and in full compliance with Mental Health Services Act regulations. The funds will be included in the Mental Health Services Act Plan or Annual Update, and reported in the Annual Revenue and Expenditure Report, beginning in the fiscal year the funds are returned to Yolo County. All such funds must be expended within three years of receipt and reflected in the Mental Health Services Act Revenue and Expenditure Report of the year received.

At this time, staff requests that the Board of Supervisors take the following actions:
  1. Approve Yolo County Health and Human Services Agency authorization (Attachment A) for release of future unencumbered funds from the Mental Health Services Act Housing Loan Program Fund; and
  2. Approve Yolo County Health and Human Services Agency authorization (Attachment B) for release of existing unencumbered funds from the Mental Health Services Act Housing Loan Program Fund.

The agenda item authorizes the County to receive $22,785.75 from the California Housing Finance Authority or the Department of Health Care Services and added to the Mental Health Services Act funds (date not determined), to be used for Mental Health Services Act Client Housing Expenses only.  Other unencumbered or disencumbered funds to be paid by Department of Health Care Services to Yolo County Mental Health Services Act in undetermined amounts over the next 30 fiscal years, also to be used for Mental Health Services Act Client Housing Expenses only.
