Recommended Action

Reason for Recommended Action/Background
State agencies that regulate activity at the landfill require the use of state-certified analytical laboratories. The previous agreement for laboratory services at the landfill expires on June 30, 2017, therefore, this proposed agreement (See Attachment A) will continue fulfillment of that requirement.

The Regional Water Quality Control Board (RWQCB) issues waste discharge requirements, which include monitoring and reporting requirements (WDRs) to landfills in the State of California. The WDRs for the landfill require the county to perform routine monitoring of surface water, groundwater, leachate, and soil, to monitor the possible impact to water quality at the landfill. The RWQCB requires the results of this monitoring to be summarized and analyzed in a report which is submitted on a semi-annual basis.  Other state and local agencies such as the Yolo County Environmental Health Division (YCEH), California Resource Recycling and Recovery Department (CalRecycle), and Yolo Solano Air Quality Management District (YSAQMD), require additional water, air, and landfill gas monitoring and testing.

The county has contracted with a third party laboratory for analytical testing services for the landfill and other locations requiring environmental analytical testing for over eighteen years.

The Division of Integrated Waste Management sent out a Requests for Proposals (RFP) to interested laboratories on April 7, 2017. The proposing laboratories were required to submit a written response to RFP requirements. The county received proposals from three laboratories.

DIWM staff evaluated the proposals, based on a number of criteria including:
• Performance Assessment sample analysis results;
• Responsiveness and completeness;
• Project Understanding;
• Qualifications and certification of the laboratory and education and experience of the staff; and
• Laboratory minimum detection limits and practical quantification limits for the analytical methods required.

Staff completed the proposal evaluations with reviews of:
• Client references; and
• Cost proposals.

BC’s proposal was rated highest by county staff on the technical details of providing high quality analytical laboratory and data management services to the County. BC’s proposal was the lowest in cost, approximately $137.00 lower than the next lowest cost proposal.

The proposed agreement would not impact the general fund. BC’s proposed cost of $86,171 is for a three-year term to provide analytical laboratory services for the standard required monitoring programs. Because analytical sampling requirements may change during the course of this agreement due to changes in regulatory requirements or landfill programs and operations, a contingency task of $33,829 (approximately 28%) is included in the agreement.

Analytical costs for the landfill are paid by landfill tipping fees, grants and state funds included in the Sanitation Enterprise Fund budget. Existing staff will perform contract management, and no additional resources will be required. Sufficient funds have been budgeted in FY 2017, in the proposed budget for FY 2018, and will be budgeted in future years.
