Recommended Action
Adopt resolution authorizing the Sheriff's Office to apply for and participate in the California State Parks and Recreation Division of Boating and Waterways (DBW) Boating Safety and Enforcement Financial Aid Program.

Reason for Recommended Action/Background
On March 26, 2019, the Board of Supervisors approved the annual revenue agreement with California State Parks and Recreation Division of Boating and Waterways DBW for fiscal year 2019-20 in the amount of $322,264. In previous fiscal years, DBW requested a certified copy of the minute order be returned along with the signed agreement. On April 2, 2019, DBW informed all participating law enforcement agencies that specific Harbors and Navigation Code language needed to be included in the minute orders or resolutions, otherwise they would not be accepted. This language certifies that all of the property tax levied on vessels received by the County is expended for boating and safety enforcement. In addition, DBW indicated that in future years minute orders would no longer be accepted.

In order to fully comply with DBW requirements now and going forward, the Sheriff's Office has prepared a resolution for Board of Supervisors approval:
  1. authorizing the County to apply for and participate in the program;
  2. adding the required code language;
  3. authorizing the County Auditor to certify the amount of prior year vessel taxes received; and
  4. specifically naming the Sheriff or his designee as a signatory on grant documents.

Further explanation as needed:
The Yolo County Sheriff’s Office has already been awarded a grant in an amount of up to $322,264 for fiscal year 2019-20, therefore no amount has been budgeted as of yet and there is no net variance from budget. Revenue amount has been consistent for several years and there is no local match requirement. Board of Supervisors approved the revenue agreement on March 26, 2019.
