Recommended Action
Introduce, waive the first reading, receive public comment, and continue to the next regularly-scheduled meeting for second reading and adoption of an ordinance (Attachment A) reestablishing a Housing Commission to govern the Housing Authority of Yolo County ("Yolo County Housing").

Reason for Recommended Action/Background
As the Board will recall from the April 3, 2018 presentation regarding Yolo County Housing governance, the purpose of this item is to take the initial steps necessary to change the governance of Yolo County Housing by delegating certain “reserved powers” held by the Board of Supervisors to a reconstituted Housing Commission, which in turn will perform all governance and oversight of Yolo County Housing.  A description of the reserved powers and other background information is included in the April 3, 2018 staff report included as Attachment B. 

In most respects the proposed change would not disturb the current functions and operation of the existing Housing Commission, which handles most oversight and governance matters.  The proposed change, however, eliminates the Board’s authority to directly review any Housing Commission decision of concern.  In this manner, the change would substantially increase the autonomy of the Housing Commission. 

The attached Ordinance includes changes to the Yolo County Code necessary to implement this approach.  In particular, it would reconstitute the existing Housing Commission with the full range of governance authority provided such commissions under state law.  It would also implement certain other changes to the composition of the Commission—an additional, fourth seat would be added to allow simultaneous representation by all cities on the Commission, and the number of at-large seats would be reduced from two to one.  Two tenant seats will be retained.  All appointments will be made by the Board of Supervisors, as required by state law, effectively ensuring the opportunity for a Board member to serve on the Housing Commission if desired.

If the Board approves the Recommended Actions, the attached Ordinance will return for potential adoption on May 22, 2018.  A resolution dissolving the existing Housing Commission and reestablishing a (technically new) Housing Commission will also be presented at that time.  Dissolution and reestablishment are necessary because state law appears to distinguish between a housing commission with full governance authority and a commission that, like the current Housing Commission, is subordinate to a board of supervisors and exercises only delegated authority. 

The Ordinance is drafted to become operative on July 1, 2018, or when the Board has appointed a majority of the membership of the reconstituted Housing Commission. Finally, as explained when this item was presented for discussion on April 3, 2018, the delegation of authority to the Housing Commission can be reversed at any time.  State law gives the Board sole discretion to, at any time, assume full control of Yolo County Housing and dissolve or modify the powers of the Housing Commission (as occurred in 2006).
