Recommended Action
  1. Receive an update on the Esparto Community Park and Aquatic Center Project;
     
  2. Adopt a resolution with findings approving adoption of a Initial Study/Mitigated Negative Declaration (IS/MND) and a Mitigation Monitoring and Reporting Plan (MMRP) for the Project pursuant to the California Environmental Quality Act (Attachments A [Resolution], B [IS/MND] and C [MMRP]);
     
  3. Adopt resolution authorizing Purchase of Fee Interest in 1.87 acres of unimproved real property located at the corner of Yolo Avenue and Plainfield Street, Unincorporated Area of Esparto, County of Yolo, State of California Assessor's Parcel Number 049-160-017 (Attachment D); 
     
  4. Approve the Purchase and Sale Agreement and Initial Joint Escrow Instructions and authorize the Chair of the Board of Supervisors to execute the Agreement (Attachment E); 
     
  5. Authorize the Chair of the Board of Supervisors to execute a grant deed in a form approved by County Counsel and to execute the certificate of acceptance conveying the real property to the County (Attachment F); 
     
  6. Authorize the County Administrator or Assistant County Administrator to execute any other documents and administer all actions necessary to complete the transfer of title to the County of Yolo and to accept the deed conveying title;  
     
  7. Approve Memorandum of Understanding and Joint Use Agreement between Esparto Unified School District and the County of Yolo for construction and operation of recreation center facilities on District property for a term of 30 years (Attachment G);
     
  8. Adopt resolution initiating proceedings, providing intention to continue assessments for Fiscal Year 2017-18, preliminarily approving the Engineer's Report, and providing notice to public hearing for the continuation of the Esparto Park Maintenance and Operations Assessment District (Attachments H [Resolution] and I [Engineer's Report]); and
     
  9. Authorize Assistant County Administrator or her designee to execute a work authorization under existing Agreement No. 14-206 with architect, Architectural Nexus, to design the project in an amount not to exceed $281,600.

Reason for Recommended Action/Background
In March 2012, the County was awarded $2,896,000 from California State Parks Office of Grants and Local Services as part of Round Two of the Statewide Park Program for the Esparto Community Park and Aquatic Center Project. The grant contract was executed in August 2013 for a grant performance period of July 1, 2011 through June 30, 2019 and a contract performance period from July 1, 2011 through June 30, 2041. On May 19, 2015, the Board of Supervisors adopted a resolution which approved the Engineer's Report and ordered the levying of the assessments within the Esparto Park Maintenance and Operations Assessment District.
 
In late 2015, it was discovered that the proposed site at 25747 Grafton Street posed significant environmental challenges. The large grove of elderberry bushes created several barriers to the success of the project including increased costs related to mitigation needs and reduction in size of the site resulting in the inability to deliver all the amenities proposed in the grant application. In October 2016, management of this project was transferred from the Community Services Department to the County Administrator's Office.
 
Staff, in collaboration with the Project Development Team, identified an alternate location for the project. The site is 8.67 acres of vacant land off of Highway 16 at the corner of Yolo Avenue and Plainfield Street. It is a combination of 6.8 acres (APN# 049-160-014) owned by the Esparto Unified School District and 1.87 acres (APN# 049-160-017) privately owned by Mr. and Mrs. Nicolas Herrera. The 6.8 acre property is zoned as local commercial and the 1.87 acre property is Public Quasi-Public. This location was submitted in Round One of the Statewide Park Development and Community Revitalization Program of 2008, which the County was not awarded. It remains the community's preferred site and has several advantages over the original proposed site, including location, land and cost. The new location serves as the gateway into the Town of Esparto and will offer a beautiful visual off Highway 16. The park will be more visible to the community and will allow for improved accessibility. It is close to downtown, adjacent to a public transportation route and will allow for easier access for residents coming from surrounding rural towns. The high school is directly across the street to the north and the elementary and middle schools are within walking distance. This land does not have environmental restrictions and its size will allow for the full development of the proposed project. The land has been well maintained as farm land which will ease construction and minimize costs.
 
Community outreach and feedback has been an important element throughout the life of this project. In addition to monthly meetings with the Project Development Team, multiple community outreach opportunities were coordinated for the residents of Esparto to ask questions and offer feedback regarding the change in location.
 
In collaboration with community leaders, the County submitted a project site change proposal to the California Department of Parks and Recreation Office of Grants and Local Services on January 20, 2017. On March 20, 2017, the County received approval of the relocation request for the project from the Office of Grants and Local Services.
 
The original Engineer's Report prepared for the Esparto Park Maintenance and Operations Assessment District was based upon the original location. Staff has partnered with SCI Consulting Group to review the Engineer's Report and re-engineer the zones of benefit based on the new location.The updates have resulted in setting the Maximum Authorized Rates which are lower than the highest original rates plus the Consumer Price Index increase. The new rates are: $76.10 for Zone A, $60.88 for Zone B, and $76.10 for Zone C, per single family equivalent benefit zone. The previous rates were: $92.00 for Zone A, $73.60 for Zone B, and $92.00 for Zone C, per single family equivalent benefit zone.
 
Due to the re-calculating and re-engineering of the Zones of Benefit, some parcels in the previous zones need to receive a credit for the excess amount charged in Fiscal Year 2016-17. The credits will be applied to parcels that were previously in the original Zones A and C at the higher assessment rate, but which are now in the revised Zone B, which is levied at a lower rate. The credit will be applied against the assessment for these parcels for Fiscal Year 2017-18.
 
The County entered into Agreement No. 14-206 on November 1, 2014 with Architectural Nexus to provide various construction consultation, design and landscape architectural services from time to time with individual work authorizations. Architectural Nexus will be completing the design portion of the project under the scope of that contract, with the execution of a work authorization in an amount not to exceed $281,600. Contract duration will be May 9, 2017 through December 12, 2019. The construction portion of the project will be put out to bid.
 
Project design will be completed in September 2017 and construction bidding will occur October through November 2017. Construction will begin in November 2017 and be completed by November 2018.
