Recommended Action
  1. Hold Public Hearing and adopt a resolution on behalf of the Esparto Fire Protection District to implement their development impact mitigation fees for fire protection services; and
     
  2. Direct the Clerk of the Board of Supervisors to send a certified copy of the resolution (Att. A) to the Clerk of the Esparto Fire Protection District.

Reason for Recommended Action/Background
Future residential and commercial development is projected to impact capital facilities necessary to maintain current levels of fire protection services. The development impact fee program will provide necessary funds to mitigate the impacts of new development on fire district capital facilities and equipment.

The purpose of the program is to establish a fire mitigation fee that generates the funds necessary to acquire capital facilities and equipment that will maintain current levels of fire protection, emergency medical and related services necessitated by new development.

The State Development Mitigation Fee Act provides authority and framework for local agencies to establish impact mitigation fee programs. The law requires that agencies must study and provide necessary information to support the imposition of fees within the District. In January 2004, the Board of Supervisors adopted a Fire District Development Impact Mitigation Fee Ordinance that authorizes the imposition of fire development impact fees.

Based on the methodology developed by a consultant, BAE Urban Economics, the Esparto Fire Protection District (EFPD) has completed the required capital facility and equipment plan and development impact fee study. The district has also adopted the required resolutions that declare the need to establish a fire protection impact fee program to adequately serve new development and acquire capital facilities to maintain the current levels of fire protection services.  A copy of the study by BAE is attached (Attachment C).
 

The recommended action is to approve the impact fees through the county's fee resolution (Attachment A). The fee would take effect 60 days after adoption of the resolution by the Board of Supervisors and payment is required prior to the issuance of a building permit. EFPD has approved the necessary resolution by their board (Attachment B). The following table details the amount of the proposed fees for different categories as reflected in Table 6 of the Fee Study.

Staff recommends approval of the attached resolution approving the Esparto Fire Protection District development impact fees based on the 2018 fee study.

Fire district staff and board commissioners were directly involved in developing and approving the required study and implementing resolutions. Staff from County Counsel and the County Administrator’s Office assisted the fire district in this process. County Counsel has also approved the resolutions as to form.
