Recommended Action
  1. Approve a proposed policy (Attachment A) for allocation of $1.5 million in one-time payments by the Yocha Dehe Wintun Nation pursuant to the April 4, 2017 Intergovernmental Agreement; and
     
  2. Approve changes to the scope and term of the Tribal Ad Hoc Subcommittee.

Reason for Recommended Action/Background
The April 4, 2017 Intergovernmental Agreement between the Tribe and County provides for $1.5 million in one-time payments:  a $1 million payment upon execution of the Agreement (received); and a $500,000 payment within 90 days after the inception of construction of the Hotel Expansion Project (forthcoming). County staff and the Tribal Ad Hoc Subcommittee have developed a proposed policy for allocation of the one-time payments. The policy, if approved by the Board of Supervisors, would allocate the $1.5 million equally to three accounts devoted to the following purposes:
 
State Route 16 Corridor Improvement Fund—This fund would be devoted to one-time capital improvement projects such as traffic and park improvements along the State Route 16 corridor from I-505 north to the County boundary. 
 
Rural Initiatives Fund—Similar to the State Route 16 Corridor Improvement Fund, this fund would be devoted to one-time capital improvements on a countywide basis in the unincorporated area. 
 
Matching Fund Contingency—This Fund would be used to provide matching funds for state, federal or other multi-jurisdictional grants (or similar efforts) to support projects and programs in the unincorporated area. 

More detail on each proposed fund is included in Attachment A.

Separately, upon approval of the new Intergovernmental Agreement, the Tribal Ad Hoc Subcommittee concluded the principal task for which it was created by the Board earlier this year. In consultation with the Board Chair and Vice-Chair, staff propose to extend the term and revise the purpose of the ad hoc subcommittee to promote continued collaboration with the Tribe during the first year of the Agreement. During this extended term, the ad hoc subcommittee would consist of Supervisors Chamberlain and Villegas and have three principal tasks: 
 
(1) to oversee initial implementation of the one-time funds policy described above;

(2) to serve as a resource to staff and the Tribal Council on issues that may arise during the first year of the new Agreement; and

(3) to provide direction to staff and to interact with the Tribal Council on initiation of any credit program undertaken by the Tribe pursuant to its 2016 Tribal/State Compact.

This approach is intended to create stability over the next year and contribute to ongoing efforts to ensure a strong, sustained partnership with the Tribe for the benefit of the Capay Valley community and the County generally. As indicated, the repurposed ad hoc committee will have a one-year sunset date.
