Recommended Action |
- Approve third amendment to Agreement No. 14-111 with CommuniCare Health Centers, Inc. to extend the term through June 30, 2018; increase maximum compensation by $140,236 for a new contract maximum amount of $569,444; and revise and add language where appropriate to clarify the requirements of this Agreement to provide Penal Code 1000 Services, Adult Outpatient Alcohol and/or Other Drug Treatment, and Adult Drug Court Services;
- Approve second amendment to Agreement No. 14-79 with CommuniCare Health Centers, Inc. to extend the term through June 30, 2018; increase maximum compensation by $33,837 for a new contract maximum amount of $119,379; and revise and add language where appropriate to clarify the requirements of this Agreement to provide Adolescent and Youth Treatment Services; and
- Approve third amendment to Agreement No. 14-132 with CommuniCare Health Centers, Inc. to extend the term through June 30, 2018; increase maximum compensation by $247,500 for a new contract maximum amount of $915,000; and revise and add language where appropriate to clarify the requirements of this Agreement to provide Perinatal Drug Medi-Cal and Other Drug Medi-Cal Services, and Child Welfare Substance Use Treatment Services.

Reason for Recommended Action/Background |
These three (3) amendments all extend the term through June 30, 2018; increase maximum compensation; change contract terms so that services can be billed to Medi-Cal or other state and federal sources; and revise and add language where appropriate to clarify the requirements of the Agreements.
The original term of these three contracts is July 1, 2014 through June 30, 2017, with the option to extend two years. For the PC1000/AOD/Adult Drug Court Services and the Adolescent and Youth Treatment Services, the Request For Proposals (RFPs) and original contracts include language that allows the option to extend two years. HHSA did not issue an RFP for the Perinatal Drug Medi-Cal/Other Drug Medi-Cal/Child Welfare Services as prior to the enactment of FY2011-12 Budget Act, CommuniCare Health Centers was a direct contractor to the state. The Budget Act realigned responsibility from State to counties. These are entitlement services and thus any willing provider can contract with us.
Approval of these amendments will allow HHSA to continue to exercise its responsibilities for the Substance Use Disorder Services and Child Welfare Services by extending these contracts through June 30, 2018, and increasing maximum compensation accordingly.
In total, HHSA is amending three contracts with CommuniCare Health Centers, Inc. These amendments are being presented to the Board of Supervisors for approval because the HHSA contract aggregate amount with CommuniCare Health Centers, Inc. exceeds the $100,000 threshold. Therefore, HHSA is requesting the approval of these amendments, as detailed below:

Competitive Bid Process:
1. PC1000/AOD/Adult Drug Court –
On March 17, 2014, HHSA (formerly Alcohol, Drug & Mental Health) issued an RFP requesting proposals from qualified providers interested in providing Penal Code 1000 (PC1000) Deferred Entry of Judgment (DEJ), and Alcohol and/or Other Drug (AOD) Treatment Program services. HHSA received two proposals from this solicitation. Both proposals were evaluated and the proposal submitted by CommuniCare Health Centers, Inc. was rated highest and found to meet all required qualifications to provide these services.
2. Adolescent and Youth Treatment –
On March 21, 2014, HHSA (formerly known as Alcohol, Drug & Mental Health) issued an RFP requesting proposals from qualified providers interested in providing outpatient individual and group alcohol and/or drug therapy services to youth through the age of 18 who have a substance use diagnosis. HHSA received one proposal from this solicitation. The proposal submitted by CommuniCare Health Centers, Inc. was evaluated and found to meet all required qualifications to provide these services.
3. Perinatal Drug Medi-Cal/Other Drug Medi-Cal/Child Welfare Services –
Prior to the enactment of the FY2011-12 Budget Act, CommuniCare Health Centers, Inc. was a direct contractor to the State. The State Budget Act realigned fiscal and administrative responsibility to provide drug Medi-Cal services from the State to counties. In turn, the contracting relationship and responsibilities for services shifted to the County effective fiscal year 2012-2013. These are entitlement services and thus any willing provider can contract with us.
