Adopt a resolution authorizing the Agricultural Commissioner/Sealer of Weights and Measures to execute specified revenue agreements, and limited amendments to these agreements with California Agricultural Commissioners & Sealers Association, California Department of Transportation, California Crop Improvement Association, California Department of Agriculture, California Rice Commission and California Department of Pesticide Regulation for fiscal years 2017-18 and 2018-19. Recommended Action
  1. Adopt a resolution authorizing the Yolo County Agricultural Commissioner/Sealer of Weights and Measures to execute the agreements listed below during fiscal year 2017/18 and fiscal year 2018/19 on behalf of Yolo County;
     
  2. Authorize the Yolo County Agricultural Commissioner/Sealer of Weights and Measures to execute any amendments to these agreements that do not (individually or when taken together with any prior amendments) exceed $50,000 per agreement during fiscal year 2017/18 and fiscal year 2018/19 on behalf of Yolo County.

Reason for Recommended Action/Background
A.   Annual agreements with California Agricultural Commissioners & Sealers Association (CACASA), California Department of Transportation (Caltrans), California Crop Improvement Association (CCIA), California Department of Agriculture (CDFA), California Rice Commission (CRC) and California Department of Pesticide Regulation (DPR) are currently signed by the Yolo County Agricultural Commissioner/Sealer of Weights and Measures as authorized by resolution #15-38 adopted by the Board of Supervisors on April 7, 2015. The proposed resolution continues the authorization for fiscal years 2017/18 and 2018/19.

Current revenue agreements are listed below; it is anticipated that revenue for these programs will remain at or near the 2016/17 funding level for the next several years.

1.  CACASA, Pesticide Use Report Data Entry Agreement: FY 2016/17 revenue of $8,024 for data entry of pesticide use reports received from growers and companies applying pesticides.

2.   Caltrans, Weed and Vertebrate Program:  FY 2017/18 and 2018/19 total revenue of $150,000 for the management of noxious weeds and burrowing rodents on CalTrans rights of way within Yolo County.

3.   CCIA, Seed Certification Program:  FY 2016/17 revenue of $10,022 for the inspection of harvest operations to maintain the quality of certified seed produced in Yolo County.

4.   CDFA, Asian Citrus Psyllid Trapping Agreement (amendment to CDFA Pest Detection Agreement):  FY 2016/17 revenue of $9,302 to place and inspect traps to detect the presence of Asian Citrus Psyllid before it becomes established in Yolo County.

5.   CDFA, Certified Farmers Market Agreement:  FY 2016/17 revenue of up to $7,254 to conduct farmers market inspections as requested by CDFA.

6.   CDFA, Dog Teams Agreement:  FY 2016/17 revenue of $141,290 for the inspection of packages designated by the Sacramento County and Contra Costa County Detector Dog Teams at the United States Postal Service regional center in West Sacramento.

7.   CDFA, High-Risk Inspections Agreement:  FY 2016/17 revenue of $23,607 for inspections of high risk shipments, such as fruit or foliage, at ground and air freight facilities, to prevent introduction of pests of concern to California.

8.   CDFA,  Light Brown Apple Moth - Detection Agreement:  FY 2016/17 revenue of $1,599 to include Light Brown Apple Moth traps along with our general Pest Detection program traps.

9.   CDFA, Light Brown Apple Moth - Regulatory Agreement:  FY 2016/17 revenue of $7,293 for regulatory compliance inspections to allow the shipment of agricultural commodities from the Light Brown Apple Moth-infested area of Yolo County.

10.  CDFA, Nursery Agreement: FY 2016/17 revenue of $865 for annual nursery stock inspection and compliance assessment at producer/wholesale nursery locations within the county.

11.  CDFA, Organic Agreement:  FY 2016/17 revenue of $720 to process CDFA organic registration applications.

12.  CDFA, Pest Detection Agreement:  FY 2016/17 revenue of $38,613 for trapping to detect insect pests of economic concern before they become established in California.

13.  CDFA, Pierce's Disease Agreement:  FY 2016/17 and 2017/18 total revenue of $42,046 to support inspection, detection, and enforcement programs related to the Glassy-winged Sharpshooter (GWSS).

14.  CDFA, Seed Services:  FY 2016/17 revenue of $5,352 for regulatory inspections of Yolo County seed processors.

15.  CDFA, Standardization Inspection Agreement:  FY 2016/17 revenue of $19,941 for the inspection of melons produced in Yolo County to assure regulatory compliance.

16.  CDFA Division of Measurement Standards, Junk Dealer Inspection Agreement:  FY 2016/17 revenue of $2,160 for inspection of licensed junk dealer facilities to verify compliance with applicable laws and regulations related to purchase of scrap metals.

17.  CDFA Division of Measurement Standards, Petroleum Products Enforcement Agreement:  FY 2016/17 revenue of $3,975 for inspection of retail fuel establishments throughout Yolo County to confirm that pricing signs and advertising are in compliance with regulatory standards.

18.  CRC, Rice Pesticide Program: FY 2015/16 revenue of $8,180 for surveillance of rice pesticide application and water holds to mitigate and eliminate impact to the waters of California.

19.  DPR, Enforcement Evaluation and Improvement Project:  FY 2016/17 revenue of $24,238 to collect data; ensure the consistent application of statewide DPR policies, laws and regulations; and track, develop and prepare enforcement responses as needed.

Executed agreements will be placed on file with the Clerk of the Board.

B.   The Yolo County Agricultural Commissioner/Sealer of Weights and Measures is currently authorized by resolution #15-38 to sign amendments, up to 15% over the approved amounts, to revenue agreements. The proposed resolution modifies the authorization for fiscal years 2017/18 and 2018/19 to allow the Agricultural Commissioner/Sealer of Weights and Measures to execute any amendments to the listed agreements that do not (individually or when taken together with any prior amendments) exceed $50,000 per agreement. This provides the Agricultural Commissioner/Sealer of Weights and Measures the flexibility required to effectively respond to unanticipated program changes.
Collaborations (including Board advisory groups and external partner agencies)
County Counsel reviews and approves all agreements as to form before they are executed by the Agricultural Commissioner/Sealer of Weights and Measures. The County Administrator's Office, CACASA, Caltrans, CCIA, CDFA, CRC and DPR support this procedure for obtaining County approval for contracts and agreements.
