Adoption of an ordinance revising current Advisory Committee Bylaws to create the South Davis Citizens Advisory Committee, adjust comment areas and county staffing, and amend the Policies and Procedures Manual to allow future changes by resolution instead of by ordinance. (Minor general fund impact) (Bencomo/Morrison)
Recommended Action(s)
A. Hold a hearing and receive public comment regarding the draft ordinance (Attachment A);

B. Certify that Categorical Exemption is the appropriate level of environmental document for this project and that it has been completed in accordance with the California Environmental Quality Act (CEQA) and CEQA Guidelines (Attachment B); and

C. Approve the ordinance revising the Bylaws for the Yolo County General Plan Citizens Advisory Committees and amending the Policies and Procedures Manual, as follows:
1. Create the SDCAC;
2. Establish a comment area for the SDCAC;
3. Modify the comment area for the Clarksburg Citizens Advisory Committee (CCAC);
4. Change the requirement that staff attend each regularly scheduled advisory committee meeting; and
5. Modify Chapter 2 of the Policies and Procedures Manual to allow future amendments to the Bylaws to be made by resolution, instead of ordinance.
Strategic Plan Goal(s)
These actions support the strategic plan goals of partnering for a successful Yolo County; and creating safe and healthy communities.
Fiscal Impact
The creation of the SDCAC would have a minor impact on the general fund. Assuming the advisory committee was to meet monthly, staffing costs would run approximately $5,000 to $10,000 annually. To the extent that staff does not attend every regularly scheduled meeting, or if savings were realized by streamlining other committee operations, those costs would be accordingly reduced.
 
Reason for Recommended Action/Background
The South Davis area has been the subject of several key land use issues in the past two years. Additional important issues are on the horizon, such as development of the Brandenburger property, the Interstate 80 technology corridor, and a proposed commercial solar facility. Currently, the residents of the South Davis area do not have a forum for making recommendations on these issues. The Willowbank and El Macero County Service Areas primarily concern sewer, water, and storm drain infrastructure and rates. Residents of the Royal Oaks Manufactured Home Community and the East Davis and No Man’s Land Fire Districts do not have a local body.

As recommended by staff, the SDCAC comment area would not include the eastern portion of the lower Yolo Bypass. Expanding the Clarksburg Advisory Committee to include this area would provide an opportunity for them to consider future projects in the bypass. This would allow Clarksburg a platform to consider issues such as the Bay Delta Conservation Plan and/or Delta Stewardship Council that have a direct impact on their community.

While staff supports the creation of the SDCAC, it should be noted that this will make a total of nine advisory committees. Three of the nine will have been created in the past four years, while the Community Development Division has reduced staffing from 21 to 9. In order to accommodate staffing for the SDCAC, a change to the Advisory Committee Bylaws is being recommended that would allow staff to attend only those meetings where a recommendation on an application and/or ordinance would be considered.

BACKGROUND

At their meeting of December 18, 2008, the Planning Commission approved a letter to be sent to the Board of Supervisors requesting the establishment of a subcommittee to address the lack of standard written procedures that govern the eight General Plan Citizens Advisory Committees in the county. The letter was included as “Correspondence” at the Board of Supervisors meeting of January 13, 2009. At that meeting, Chair McGowan requested that the item be continued until after he had an opportunity to discuss the matter with the Planning Commission Chair.

On March 10, 2009, the Board of Supervisors approved an Ad Hoc Planning Commission subcommittee and directed staff to report back in six months. On October 13, 2009, staff presented the subcommittee’s recommendations. The proposed Bylaws included several changes to improve the function of the Citizens Advisory Committees. At that time, the idea of creating a SDCAC was considered, but not supported.

At the March 15, 2011, Board of Supervisors meeting, the draft ordinance was introduced by title, the first reading was waived, and the item was continued. At that meeting, the Board of Supervisors also provided direction to the Planning Commission to work with staff and the advisory committees to evaluate how meetings could be made more efficient.
Other Agency Involvement
County Counsel has reviewed the draft ordinance. Staff has also coordinated with the County Administrator’s Office in preparing this report.
