Recommended Action(s)
A. Support the North Delta Water Agency proposed annual assessment adjustment; and,
B. Direct the County Administrator to vote the Official Ballot in support of the proposed assessment on:
  1. APN 043 160 43: 51230 Clarksburg Road, Clarksburg $8.00 per year increase
  2. APN 067 310 68: 1212 Merkley Ave, West Sacramento $8.00 per year increase
  3. APN 045 182 29: Allen Avenue, West Sacramento $8.00 per year increase
  4. APN 010 559 02: 1038 Triangle Court, West Sacramento $8.77 per year increase
  5. APN 043 210 29: Co Rd 152, Clarksburg $8.00 per year increase

Fiscal Impact
Support of the proposed annual assessment adjustment will result in an annual cost to the county general fund of $40.77 per year.
Reason for Recommended Action/Background
Support of the proposed assessment adjustment will allow the North Delta Water Agency to:
  1. pay for the 1981 Contract that assures property owners within the Agency’s boundaries, that includes certain county parcels, an adequate supply of suitable quality water;
  2. cover the costs to administer and enforce the Contract; and,
  3. assure a dependable supply of suitable quality water sufficient to meet present and future needs for reasonable beneficial uses, including defending the water supply and water quality guarantees under the Contract.

BACKGROUND

In 1981, when the Peripheral Canal was last approved by the State Legislature, the North Delta property owners approved an “insurance policy” via a Contract between the State of California Department of Water Resources (DWR) and the North Delta Water Agency (NDWA) that assures an adequate supply of water of suitable quality for reasonable and beneficial uses within the NDWA boundaries, including agricultural, municipal and industrial supply. NDWA makes an annual payment to DWR in exchange for the water quality and supply benefits provided to all North Delta property owners.

NDWA is asking property owners to vote on a proposed increase of the annual assessment it levies to make the annual Contract payments, proactively enforce the extraordinary protections of the 1981 Contract, and legally defend against any actions in the Delta that would violate the terms of the 1981 Contract.

The NDWA currently does not have adequate staffing or a mechanism in place for collection of current assessments outside of the tax roles. Thus, the county has not been paying the current annual assessment totaling $40.00 for the above referenced parcels. The proposed adjustment to the current annual assessment results in a $.77 increase to the county. The new annual assessments for all parcels would be $40.77. If the proposed increased assessment is enacted, NDWA will then have the resources necessary to bill outside of the tax rolls including the parcels owned by the county and other public agencies.
