Reason for Recommended Action/Background |
The Board of Supervisors is the code reviewing body under State law for special districts and certain other agencies, including Reclamation District 2035 ("District"). As such, it is legally responsible for reviewing and approving the amended conflict of interest code adopted by the District on March 16, 2016 and submitted to the County in February of 2017.
The amended code includes all language currently required by law. Under Government Code Section 87309, the Board may approve an amended conflict of interest code unless it finds that, as amended, the code (a) fails to provide reasonable assurance that all foreseeable potential conflict of interest situations will be disclosed or prevented, (b) fails to provide to each affected person a clear and specific statement of his or her duties under the code, or (c) fails to adequately differentiate between designated employees with different powers and responsibilities.
The Office of the County Counsel believes that it is appropriate for the Board of Supervisors to approve the amended code. It comports with all requirements of state law and represents a straightforward update to the existing District conflict of interest code. |
