Subject
Approve agreement with Esparto Community Services District regarding the transfer of the Esparto Corporation Yard to District in exchange for $80,000. (No general fund impact) (4/5 vote required) (Echiburu)
Recommended Action
  1. Find that the County property is not required for County use, approve Agreement with Esparto Community Services District regarding transfer of Esparto Corporation Yard to District in exchange for $80,000, and authorize the Chair to execute the Agreement and Quitclaim Deed; and
     
  2. Authorize the Director, Public Works Division to deposit funds received from the District into the Road Fund, and take all other actions necessary to transfer the property to the District; and
     
  3. Authorize the Clerk of the Board to record the quitclaim deed once funds are received from the District.

Reason for Recommended Action/Background
The agreement will allow underutilized County property to be transferred to the Esparto Community Services District.           
 
Background
The corporation yard at 26981 Woodland Avenue in Esparto is operated and administered by the Public Works Division.  (See Attachment C-Location Map and photos.)  The property is zoned PQP, Public/Quasi-Public, which permits public or government office, places of worship, schools, libraries, and civic uses.
 
Since acquisition of the property in 1920, the Road Fund has paid for improvements at the site including a former service station with a main shop, an office building, a garage, and underground fuel tanks.  The underground fuel tanks at the site leaked, but have since been removed.  Soil and groundwater investigations were conducted from 1995 to 2010 to monitor contamination. It was determined that the contaminants were degrading naturally and would not adversely affect the groundwater or human health. The California Regional Water Quality Control Board issued a letter dated October 18, 2012 stating that the site investigation and corrective actions were in compliance with the California Health and Safety Code, and no further action was necessary. 
 
Current road maintenance operations are centralized at the Public Works corporation yard on Beamer Street in Woodland, and the use of outlying corporation yards is limited to occasional equipment parking.  Due to the operational efficiency of centralized County road maintenance operations, no future use of the Esparto yard is anticipated.  Because the Esparto yard has not been actively utilized for the past 10-15 years, vandalism has been a problem, and the site is currently a liability for the Public Works Division. 
 
The Esparto Community Services District provides water, sewer, and streetlight services to the community of Esparto.  The District operates a corporation yard at 26964 Woodland Avenue, directly across the street from the County yard.  District staff approached Department staff about the possibility of acquiring the County property, and Department staff arranged for an appraisal of the property.   Integra Realty Resources prepared an Appraisal of Real Property dated January 26, 2017, and valued the property at $80,000.  The $1,500 cost of the appraisal has been paid for by the Road Fund.  The District has approved the attached agreement to pay the County the appraised value, and has agreed to accommodate parking of County equipment in the future, if it doesn’t interfere with District operations.  
 
Under Government Code section 25365, County property may be conveyed if the Board of Supervisors finds, by a four-fifths vote, that the property is not required for County use.  The proper public notice of this intended action has been published, as required by Government Code section 25365.
