Recommended Action
  1. Reintroduce by title only and waive second reading of an ordinance amending Section 10-4.412 of the Off-Channel Surface Mining Ordinance related to dewatering (Attachment A); and
     
  2. Certify the Addendum to the Off-Channel Mining Plan Environmental Impact Report (SCH #95113034) as the appropriate level of environmental documentation in accordance with the California Environmental Quality Act (CEQA) and CEQA Guidelines (Attachment B).

Reason for Recommended Action/Background
The Board of Supervisors held a public hearing to review and discuss the proposed ordinance amendment on February 21, 2017. The amendment would remove the prohibition on dewatering for mining activities, which is defined as “lowering the water level in a wet pit by pumping water from the pit, regardless of the purpose of the pumping.”  The water generated from dewatering activities must be used and discharged on-site.  The proposed amendment requires a site-specific technical analysis by a qualified and experienced engineer or geologist to ensure no adverse impacts.  The amendment also requires monitoring of water levels and nearby wells, and periodic reporting.  If adverse impacts are found, they must be mitigated, such as by well modification, well relocation, compensation of well owners for increased pumping cost, or providing an alternative water supply.  The amendment requires that any such mitigation must be approved by the Planning Commission at a regularly-scheduled meeting, with notice to all property owners within 1,000 feet of the pit boundary in addition to any notice otherwise required by law.

The Yolo County Planning Commission recommended, by a 7-0-0 vote at a January 19, 2017 public hearing, that the Board of Supervisors approve the amendment. An Addendum to the Off-Channel Mining Plan Environmental Impact Report (SCH #95113034) has been prepared for this project.
