Recommended Action
  1. Approve amendment to agreement with Wood Rodgers, Inc. in the amount of an additional $3,000 for the Willowbank Community Service Area (CSA) Water Service Feasibility Study, and authorize the Director of Planning, Public Works and Environmental Services to sign; and
     
  2. Authorize the Director of Planning, Public Works & Environmental Services, or his designee, to work with the County Counsel to negotiate and acquire a three-year option to purchase the existing irrigation well on the former Nishikawa property south of Montgomery Avenue, the related exclusive easement and the 6" or 8" pipeline from the wellhead to Montgomery Avenue.

Reason for Recommended Action/Background

In April 2015 the Willowbank CSA requested that Wood Rodgers, Inc evaluate the feasibility of constructing separate potable and irrigation water systems from the existing combined potable and irrigation system.  Upon issuing the final draft of the Willowbank feasibility study, Willowbank representatives received new information on an existing well located south of the intersection of Oakside Drive and Montgomery Avenue ("Oakside Well") that could supply irrigation flows to the Willowbank CSA. This alternative could result in significant savings, therefore the CSA has requested that Wood Rodgers include the alternative of the existing Oakside Well in the feasibility study.

Willowbank Farms LLC has issued a letter to the Willowbank CSA Advisory Committee confirming interest in the sale. In order to have the exclusive option of review and purchase consideration of the Oakside Well, Willowbank Farms LLC has proposed granting a 3 year option to purchase the Well, together with a 6" or 8" underground pipeline that would be installed between the well head and the south side of the public right of way on Montgomery Avenue. Should the project come to fruition in the future, the County/CSA would be responsible for the pipeline extension across the pavement at Montgomery. The cost of the option at this time is $1. The purchase price of the Oakside Well and appurtenant pipeline is currently set at $65,000 cash sum. This proposal is non-binding, meaning neither the CSA or Willowbank Farms LLC would have any commitment regarding the option unless and until it is fully negotiated. The Willowbank CSA Advisory Committee made a motion to recommend purchasing the option for $1 in a 6-1 vote at the public CSA meeting on March 9, 2016. The copy of the motion as well as the Willowbank Farms LLC letter are attached.

The option agreement will be prepared in coordination with the Office of the County Counsel.  The option agreement will be drafted in a manner that allows the Board of Supervisors (acting as the CSA Board) to take final action on the acquisition of the well/pipeline when appropriate.

The approval of the contract amendment will not impact the county general fund.  All funds are expensed directly by the Willowbank County Service Area and have already been included in the 2015-16 budget.
