Recommended Action
  1. Adopt plans and specifications for the replacement of the County Road 99W Bridge over Buckeye Creek;
     
  2. Authorize the Director of Public Works to revise the plans and specifications once permits are issued, and to sign the Notice to Contractors.;
     
  3. Authorize the Department of Community Services, Public Works Division, to advertise for competitive bids once authorization to proceed with construction is approved by Caltrans;
     
  4. Authorize the Director of the Department of Community Services or the Director of Public Works to execute a construction contract with the lowest responsive bidder, provided the contract amount does not exceed available funds, or to reject all bids;
     
  5. Authorize the Director of the Department of Community Services or the Director of Public Works to approve all construction change orders, provided the contract amount does not exceed available funds for the project.

REASON FOR RECOMMENDED ACTION 
These actions will allow the department to solicit competitive bids once Caltrans authorizes the project and permits are issued, to expedite the contract award, and promptly proceed with construction.
 
BACKGROUND 
The bridge is located on County Road 99W over Buckeye Creek, approximately 0.48 mile southeast of County Road 1 near the community of Dunnigan.  The purpose of the Project is to replace the bridge.  When County staff first applied for federal funds for the project in August 2010, Caltrans inspection reports classified the bridge as structurally deficient, and assigned a sufficiency rating of 32.5 out of 100.  The bridge is scour critical, and during the January 2017 storms, creek flows exposed portions of the footing of the bridge, highlighting the need to proceed with the project. (Attachment C)  The new bridge will have deep footings that will not be subject to scour damage.
 
The project is eligible for 100% federal funding through the State Highway Bridge Program (HBP).  For the construction phase, $3,448,000 in federal funds are programmed in the HBP in federal fiscal year 2017/18, which begins October 1, 2017.  Since the project is ready for construction, the County can request ‘advanced authorization’ for construction, to allow construction to begin prior to the October 1, 2017 date.    Once Caltrans approves an ‘advanced authorization’ request, the construction phase of the project can begin, but the federal funds would not be available until after October 1, 2017.  Local funds would need to fund construction of the project until Caltrans authorizes ‘conversion’ of construction funds, after which point federal funds will be fully authorized and reimbursements would begin.  There are sufficient funds in the Road Fund to pay the contractor’s invoices until federal reimbursement can be secured.
 
A ‘conversion’ of federal funds may be available as early as April or May 2017, if other bridge projects throughout the state do not request  the funds identified for their projects by March 1.  After March 1, bridge projects in the HBP that aren’t ready to deliver lose their funding, and those funds are available to projects that are ready to construct, like the Buckeye Creek bridge.  Staff will make every effort to ensure funds are authorized as quickly as possible in either case.  
 
Staff applied for a variety of permits required for the project in late December 2016, but the agencies have not yet issued their permits.  Revisions to the plans and specifications will likely be required to ensure that bids cover all the work required by permits.  Due to the number of working days needed to complete the project, and the environmental restrictions on the time of year that work can occur, the award of the project needs to occur as early in the construction season as possible.  If the project is not circulated for bids by mid-March 2017, it will have to wait until 2018 to begin.   
 
The project will take approximately 140 working days to complete and is expected to be completed in 2018.

The engineer’s estimate, including contingency and construction engineering, is $3,448,000. $210,000 was budgeted in the FY2016/17 Road fund budget, which is sufficient for the first progress payment expected in June 2017.  The balance of the funds will be included in the recommended FY 2017/18 Road Fund budget.
