Recommended Action |
- Authorize the Chair to sign an amendment to increase the caps for the agreements with Bureau Veritas North America, Inc. (Attachment A) and TRB+ Associates (Attachment B) from $300,000 to $500,000 for building plan review, building inspection and other permit-related professional services on an as-needed basis. Each contract provides that compensation shall not exceed $500,000 during the three-year term.
- Authorize the Director or designee to increase the annual disbursement of agreement funds that exceeds $100,000 for each three-year term agreement. Total compensation would not exceed $500,000 for each contract over the three-year term.

Reason for Recommended Action/Background |
Building permit activity has nearly doubled in the last few years. In particular, large project applications in the County have created a demand for services relative to plan review, inspection, and other permit-related services from outside consultant review firms that exceeds the $300,000 limit currently contracted. In addition, the existing $100,000 annual limit for these contracts creates a challenge for projects that are in the middle of review and must wait for Board approval to increase the approved limit. In order to address these issues and maintain permit review continuity in an efficient manner, staff recommends that the agreements with Bureau Veritas North America, Inc., and TRB+ Associates be amended, as shown in attachment A & B, from $300,000 to $500,000. By amending these agreements, staff will have the flexibility to continue assigning projects to contract plan reviewers and/or inspectors who are best suited to meet Building Inspection Division needs.
In addition, staff is requesting that the Department Director be authorized to approve amounts in excess of $100,000 in any given year for contracted services, with the ability to renew the amount each year during the term of the contracts (three years), resulting in an amended contract amount of up to $500,000 for each firm, over the three-year contract period. As proposed, each contract may be extended for two one-year terms by the Director, for a total term of five years. Extensions are contingent upon the appropriation of funds by the division in the annual budget for such fiscal year, as well as County Counsel approval of any related extension documents. The total not-to exceed amount for each contract would be $500,000 over the full three-year term. These actions will help the Building Inspection Division maintain responsive and accurate customer service throughout the contract period.

The two contracts will each be increased from $300,000 to $500,000, totaling a $400,000 increase.
There would be no impact to the general fund as a result of the recommended actions. Funding for contractual plan review, inspection and other permit-related professional services as described herein is generated directly from the fees collected for plan review and building permits.
