Reason for Recommended Action/Background
On November 27, 2017, staff released a request for proposals (RFP) seeking applications for up to three nursery licenses and up to three processing facility licenses. Although the document is referred to as an RFP given the familiarity of that term, the document to be submitted is an application rather than a proposal, since the respondents are applying for a license.

As part of the RFP, potential applicants were required to submit a mandatory Letter of Interest by 4:00 p.m. on December 5, 2017, stating their intent to submit an application. Also to be included in the letters were outlines or summaries of some of the items to be included in the application, which included:
  • Neighborhood Compatibility Plan (how traffic, light, noise, odor, and aesthetics will be mitigated);
  • Safety and Security Plan;
  • Description of Applicant's experience operating the same or similar business; and
  • Community Benefits Plan (for applicants seeking a longer term license, the applicant could propose entering into a development agreement with the County)
A total of eight Letters of Interest were received by the deadline stated in the RFP; five for nurseries, two for processing facilities, and one for both a nursery and processing facility.  One letter was received after the deadline and was therefore rejected.

Failure to have submitted a mandatory Letter of Interest by the 4:00 p.m, December 5th deadline precludes an applicant from submitting an application. In addition, a mandatory applicant's conference will be held on December 11, 2017. Failure to attend the applicant's conference will also preclude a potential applicant from submitting an application.

Staff will provide the Board an update on the number of entities who both submitted a mandatory Letter of Interest and attended the mandatory applicant's conference and discuss options for potentially accelerating the application review process.
