Reason for Recommended Action/Background
The Administrative Policies and Procedures Manual section regarding the County of Yolo’s gift policy has not been revised since November 2002. The extant policy is in conflict with County-supported initiatives, such as Health and Human Services Agency’s Adopt-a-Family holiday gift program. Currently, a cash donation to this program, with the intent for County staff to purchase gifts for the program, would have to be approved on a case-by-case basis by the Board of Supervisors due to the donation being for a “restricted use.”  The primary intent of the policy was to comply with Government Code 89503 and ethical guidelines regarding acceptance of gifts.  However, when taken in the context of our broader work on community gifts, the conflict described above occurred. 

The attached policy has been updated to allow flexibility in accepting charitable donations for County-supported activities while also strengthening language regarding employee gift acceptance.

Updates to the policy include:
  1. Gift value threshold amounts for oversight of acceptance of larger gifts and donations with specific intent for use or restrictions.
    1. Board of Supervisor approval and acceptance of gift of $50,000 maintained, regardless if gift use is restricted or not.
    2. Ability of Department Heads and the County Administrator to accept “restricted use” gifts under the current “non-restricted” gift threshold.
  2. Language permitting Department Heads, the County Administrator, and the Board of Supervisors to make an “ask,” when County-supported activities, such as Adopt-A-Family, seek donations or gifts.
Staff recommends approval of the attached policy as an interim measure to allow for gifts to and through the County during this holiday season.  Staff will return with two separate policies that are more easily utilized for the two specific situations of gifts directly to individuals versus gifts to the County.
