Recommended Action |
- Reintroduce by title only, waive first reading, and receive public comments regarding an ordinance adding Chapter 12 to Title 10 of the Yolo County Code in order to prohibit Off-Highway Vehicle (OHV) use in Cache Creek from 7:00 PM to 6:00 AM; and
- Direct staff to bring the ordinance back for adoption on January 12, 2016.

Reason for Recommended Action/Background |
On November 17, 2015, the Board introduced this ordinance by title only, waived the first reading, and accepted comments from the public. Staff has since made three modifications to this ordinance:
- Per the Board's direction, OHV's will be prohibited in Cache Creek between the hours of 7:00 PM and 6 AM (formerly, the prohibition was proposed from 8:00 PM to 6:00 AM).
- Also consistent with the discussion on November 17, 2015, the ordinance has been revised slightly to clarify that the prohibition applies to landowners using OHVs on portions of their private property lying within Cache Creek between 7:00 p.m. and 6:00 a.m. This approach is necessary to reduce barriers to effective enforcement of the ordinance and to promote its overall success in reducing the deleterious effects of OHV use in Cache Creek.
- Staff corrected a minor formatting/numbering error in the ordinance.
Rather than request adoption of the ordinance at this time, staff concluded it would be appropriate to reintroduce the ordinance with these changes included. Unless otherwise directed, staff will return with the ordinance for a second reading and adoption in January 2016. |

On November 17, 2015, the Board adopted a budget resolution increasing the budget of the Sheriff's OHV Enforcement Team by $100,000 of contingency funds (one-time general funds). The increased funds will be expended as follows
