Approve second amendment to revenue agreement with Safety Center Incorporated as the Driving Under the Influence provider for Yolo County for the period August 1, 2010 through June 30, 2017. (No general fund impact) (Larsen)
Recommended Action
  1. Approve second amendment to revenue agreement with Safety Center Incorporated as the Driving Under the Influence provider for Yolo County for the period August 1, 201 through June 30, 2017.
  2. Delegate authority to the Director of Health and Human Services Agency or his/her designee to sign and execute any additional forms, documents, amendments, corrections, and changes necessary relating to this agreement.
  3. Instruct the agency to provide an update to the Board regarding any significant changes to the program as it relates to this agreement.

Reason for Recommended Action/Background
The Driving under the influence program as defined and in accordance with the provisions of Title 9, California Code of Regulations, Division 4, Chapter 3, “Programs for Alcohol and Drug Impaired Drivers” and Driving Under the Influence Program Law, Health and Safety Code Section 11836-11838.11, the County is primarily responsible to ensure fiscal integrity of licensed Driving Under the Influence programs.
 
In May 2010, Safety Center Incorporated, through the county’s Request for Proposal (RFP) process, was selected as the Driving Under the Influence (DUI) Program provider. Safety Center Incorporated has completed the State licensing requirements, and will provide the required DUI programs that were formerly provided by Yolo County Alcohol, Drug and Mental Health.
 
On July 27th, 2010 the Board of Supervisors approved the selection of Safety Center Incorporated as the DUI Program provider for Yolo County and recommended the agency for licensure.  Safety Center Incorporated completed the licensing requirements and was operational for transfer of the program on August 2, 2010.
 
Safety Center Incorporated provides DUI education programs to persons arrested for driving under the influence of alcohol and referred by the Department of Motor Vehicles, by the Yolo County Superior Court as a condition of probation, or transfers from State licensed programs in other California counties and those pleading guilty to or pleading nolo contendere to “wet and reckless” driving.
 
Performance Measures:
Safety Center Incorporated is expected to complete the described services for all persons who are enrolled in the program, as well as satisfactorily fulfill all other contractual requirements. DUI program outcomes will focus on reduction of substance use disorder and related offenses, e.g. incarceration rates, fines and insurance costs.
 
Competitive Bid Process:
On May 6, 2010, an RFP was issued for these services and Safety Center Incorporated was the sole respondent to this RFP. 
 
Contracting History:
On July 27, 2010, the Board of Supervisors approved original Agreement with Safety Center Incorporated as the DUI provider for Yolo County for the period August 1, 2010 through June 30, 2011.
 
On March 26, 2013, the Yolo County Purchasing Agent approved First Amendment with Safety Center Incorporated to extend the term through June 30, 2015.

There is no general fund impact by this action.  Direct and indirect costs incurred by the County in monitoring, evaluating, and/or auditing the provided services shall be reimbursed by Safety Center Incorporated to the County in accordance with Title 9, Section 9801.5.  The reimbursement amount is established at 5% of the fees collected from first offender clients and 5% of the fees collected from multiple offender clients.  It is estimated that $30,000 annually for a total of $210,000 shall be forwarded to the County.
