Recommended Action |
- Receive update on a) impacts from Off-Highway Vehicle (OHV) activity in and along Cache Creek, b) law enforcement activities pertaining to OHV enforcement, and c) the status of planning activities for a new OHV park;
- Introduce by title only, waive first reading, and receive public comment on a proposed ordinance amendment to Title 10, Chapter 12, "Off-Highway Vehicle Use (OHV) and Operation" of the Yolo County Code which, if approved, would ban the possession and consumption of alcohol and make certain safety equipment mandatory for all OHV riders;
- Find the ordinance amendment exempt from CEQA under CEQA Guidelines Section 15061(b)(3); and
- Continue adoption of the ordinance to the next regularly scheduled meeting of July 27, 2021.

Reason for Recommended Action/Background |
County staff from the Natural Resources Division, Parks Division, and Yolo County Sheriff's Off-Highway Vehicle (OHV) Enforcement team will provide the Board an update on OHV activity in and along lower Cache Creek. The presentation will include:
- Update on OHV activity and complaints from the public (Natural Resources Division)
- Update on enforcement activities undertaken by the Sheriff's OHV Enforcement team (Sheriff)
- Overview and status update on the OHV Park planning project (Parks Division)
It is also recommended that the Board consider approval of an amendment to Yolo County Code, Title 10, Chapter 12, titled "Off-Highway Vehicle Use and Operation". If approved, the ordinance will amend Section 10-12.101 of the OHV Use and Operation Ordinance to include definitions of Cache Creek and Public Land; amend Section 10-12.103 to prohibit the possession and consumption of alcohol on the bed or banks of Cache Creek; and create Section 10-12.106 which will require safety equipment for all OHV riders, including helmets and whips and flags.
The ordinance amendment would return to the Board for a second reading at a future date. If approved, the ordinance amendment would be exempt from CEQA under CEQA Guidelines §15061(b)(3) because "it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment." |
Collaborations (including Board advisory groups and external partner agencies) |
Staff from the Natural Resources and Parks divisions have collaborated extensively with: interested members of the public, residents and landowners along Cache Creek, the Cache Creek Conservancy, Yolo Audubon, the Sheriff's OHV Enforcement team, the County's OHV Stakeholder committee (developed as part of the OHV Park planning process), Supervisorial District 5, and the relevant fire protection districts. The results of this collaboration were presented to the County's Parks, Recreation, and Wildlife Advisory Committee (PRWAC) in February 2021. The items presented in this update were based on recommendations provided by PRWAC. |
