Recommended Action
Approve work authorization amendment under Agreement 17-122 with Tschudin Consulting Group for the development of the Cannabis Land Use Ordinance by increasing the amount by $115,000 for a total not to exceed amount of $323,600; and extending the term an additional twelve months for a revised period of December 17, 2017 to June 30, 2020.

Reason for Recommended Action/Background
Since December 2017, Tschudin Consulting Group has been assisting the County on the development of the Cannabis Land Use Ordinance (CLUO) and Program Environmental Impact Report (PEIR). The original work authorization was $83,600 and was amended on June 5, 2018 by $125,000. The term of the work authorization was also extended from March 30, 2019 to June 30, 2019.

Given the complexity of the CLUO, the PEIR (which is evaluating five equal weight alternatives), the additional staff, Planning Commission, and Board meetings to support this effort, additional funding is necessary. Specifically, the additional amount would cover assistance with the completion of the draft PEIR, participation in public outreach meetings, as appropriate, finalization of the CLUO and Final PEIR, and participation in Planning Commission and Board meetings and hearings, as appropriate.

In addition, given the time required to complete the PEIR process, the term of the work authorization must be extended through June 30, 2020. Although staff anticipates the process to be complete prior to that date, the additional time and funding are intended to cover any unanticipated delays.

Competitive Bid Process
On-call contracts were solicited and reviewed in compliance with Department of Financial Services policies and procedures. Contracts were approved by the Board of Supervisors in June 2017. Board approval of this work authorization is required because the total compensation (FY 17/18, FY 18/19, and FY 19/20) will exceed $100,000.
