Reason for Recommended Action/Background
A temporary construction easement is required on this property for the County Road (CR) 95 Bridge Replacement project over Dry Slough.   Pattison and Associates, Inc., a property acquisition consultant, provided a waiver valuation, and an accompanying independent review of the waiver valuation, to determine the value of the property.  County staff worked with the property owners to come to a mutually acceptable agreement for the purchase.

Background
The CR 95 Bridge over Dry Slough (22C-125) is located approximately 300 feet north of the intersection with CR 31. The existing 21-foot wide bridge built in 1930 was classified by Caltrans as functionally obsolete with a sufficiency ratio of 47.7 of 100.  The new bridge will be 40-foot wide comprised of two 12-foot lanes and eight-foot shoulders.  During construction a two-way on-site detour will be provided to allow the West Plainfield Fire Department access to the southern portion of the fire district and allow continued access for the surrounding community.  In accordance with the California Environmental Quality Act, CEQA , a mitigated negative declaration for this project was adopted on September 7, 2017.  Pursuant to the National Environmental Protection Act, NEPA, a categorical exclusion was approved on October 13, 2017.

The temporary construction easement is needed for the on-site detour during the bridge construction.

In accordance with federal requirements for property acquisition, just compensation was established by the County based on the approved waiver valuation and an offer was delivered to the owner on February 21, 2019.  Since that time, staff has worked with the property owners to reach an acceptable agreement as shown in the attached Agreement.

Once right of way has been acquired, then utility providers will be able to relocate their facilities.  Utility relocation is anticipated to occur in the winter of 2019.  Provided utilities can be relocated on this schedule, construction of the bridge is anticipated in the summer of 2020.
