Recommended Action |
- Approve and authorize the Director of Public Works to sign the agreement with Davis 190, LLC for $46,000 for acquisition of a road and utility easement and a temporary construction easement for the County Road 95 Bridge Replacement Project over Dry Slough; and
- Authorize the Director of Public Works to approve payment, open escrow, accept the easement, and record the deed once the signed deed has been received and escrow has closed.

Reason for Recommended Action/Background |
A permanent road and utility easement and a temporary construction easement are required on this property for the County Road (CR) 95 Bridge Replacement project over Dry Slough. Pattison and Associates, Inc., a property acquisition consultant, provided an appraisal, and an accompanying independent review appraisal, to determine the value of the property. County staff worked with the property owners to come to a mutually acceptable agreement for the purchase.
Background
The CR 95 Bridge over Dry Slough (22C-125) is located approximately 300 feet north of the intersection with CR 31. The existing 21-foot wide bridge built in 1930 was classified by Caltrans as functionally obsolete with a sufficiency ratio of 47.7 of 100. The new bridge will be 40-foot wide comprised of two 12-foot lanes and eight-foot shoulders. During construction a two-way on-site detour will be provided to allow the West Plainfield Fire Department access to the southern portion of the fire district and allow continued access for the surrounding community. The CEQA mitigated negative declaration for this project was approved on September 7, 2017. The NEPA categorical exclusion was approved on October 13, 2017.
The permanent road and utility easement is needed to accommodate the bridge widening and relocation of the utilities. The temporary construction easement is needed for the on-site detour during the bridge construction.
In accordance with federal requirements for property acquisition, just compensation was established by the County based on the approved appraisal and an offer was presented to the owner’s representative on December 22, 2018. Since that time, staff has worked with the property owners to reach an acceptable agreement as shown in the attached Agreement.
Once right of way has been acquired, then utility providers will be able to relocate their facilities. Utility relocation is anticipated to occur in the winter of 2019. Provided utilities can be relocated on this schedule, construction of the bridge is anticipated in the summer of 2020. |

The approved recommended FY 2019/20 road fund budget includes sufficient funds for right of way acquisition for this project. The total cost will be reimbursed by federal transportation funds at a rate of 100%.
