Recommended Action
  1. Approve third amendment to Agreement No. 17-174 with Psynergy Programs, Inc. to include updated rates for fiscal year 2019-20 with no change in maximum compensation for the provision of sub-acute psychiatric residential or Specialty Mental Health Services to seriously mentally ill adults for the period July 1, 2017 through June 30, 2020; and
     
  2. Delegate authority to the Director of Yolo County Health and Human Services Agency or his/her designee to approve/exercise the option(s) to extend the term of this Agreement on the same terms and conditions as set forth in the Agreement for up to two (2) additional fiscal years (July 1, 2020 through June 30, 2021; and July 1, 2021 through June 30, 2022) not to exceed $575,000 per fiscal year, for a 5-year maximum payment obligation not to exceed $2,875,000. Reason for Recommended Action/Background
Psynergy Programs, Inc. operates Adult Residential Facilities (ARF), Residential Care Facilities for the Elderly (RCFE) and outpatient mental health clinics in close proximity. Psynergy Programs, Inc. has demonstrated that providing reliable adult residential home care in combination with intensive outpatient mental health services can help individuals with mental illness avoid the unnecessary expense and emotional trauma often associated with incarceration and hospitalization. The ultimate goal of Psynergy Programs, Inc.’s services is to improve each individual’s quality of life, to help individuals gain the skills and ability necessary to stay out of locked hospital settings, and to move into a less restrictive living arrangement in the community.

This amendment is being presented to the Board for approval, as the optional year extensions were not included in the original agreement. This amendment will add updated rates for fiscal year 2019-20 with no increase to the maximum compensation; and allow the Director to exercise the option to extend the term of this agreement for up to two (2) consecutive one-year periods on the same terms and conditions. 

Approval of this amendment will allow for the continued placement of current consumers with Psynergy Programs, Inc., and help the County in providing needed services for seriously mentally ill and conserved consumers, thereby reducing the risk of placement at facilities with a higher level of care, including locked long-term hospital settings.

Competitive Bid Process
The original agreement was procured through an “Any willing Provider” exception, which was approved by the Board on July 31, 2007.  The Board of Supervisors granted an approval to the Yolo County Health and Human Services Agency, formerly known as Alcohol, Drug and Mental Health, for certain exceptions to the contract procurement policy. According to this approval, 24-hour service providers are classified as “Any willing providers” and are exempt from the competitive bid process.

In no event shall the term of the agreement extend beyond June 30, 2022 nor shall the total contract maximum exceed the amount of $2,875,000, including the remaining option year, unless otherwise agreed to in writing by the parties and in conformity with the Yolo County Procurement Policy approved by the BOS on December 11, 2018, via Minute Order No. 18-202.
