Recommended Action
  1. Approve first amendment to Agreement No. 19-230 with BHC Sierra Vista Hospital to reduce funding by $120,000 in fiscal year (FY) 2020-21 and by $120,000 in FY 2021-22, for a total contract reduction of $240,000 and resulting in a new contract maximum of $1,170,000, for the period of July 1, 2019 through June 30, 2022; update contract language; and update the performance measures; and
     
  2. Reduce the available optional extension amounts for FY 2022-23 and 2023-24 from $470,000 to $400,000 and reauthorize the Director of the Health and Human Services to exercise the optional extensions and issue the related notices.

Reason for Recommended Action/Background
California state law mandates the County to provide psychiatric inpatient hospital services to eligible Medi-Cal and non-Medi-Cal mental health consumers.  Woodland Memorial Hospital is the designated and responsible hospital to provide these services to Yolo County residents adults (age 18 or older) who meet California Welfare and Institutions Code criteria and/or who are a danger to self, others or are gravely disabled and require inpatient acute psychiatric services.
 
When no adult bed space is available at Woodland Memorial Hospital, or when a child or adolescent is in need of services, the patient must be treated by another qualified psychiatric hospital facility in the surrounding area.  BHC Sierra Vista Hospital, being such a facility, is equipped to provide appropriate services to meet our clients’ needs.
 
The County is responsible for serving all Yolo Medi-Cal beneficiaries regardless of age.  The Contractor is not certified to bill Medi-Cal for services provided to Yolo Medi-Cal beneficiaries whose age is between 21 and 64 years of age. Thus, federal financial participation (FFP) is not available for these services. The stated contract amount is to be used for funding the services related to this particular group.
 
For services provided to Yolo Medi-Cal beneficiaries whose age is either 20 or younger, or 65 or older, the payment to the Contractor for this population is not paid directly via the County.  The Contractor bills Medi-Cal directly to receive funding via FFP and the County’s mental health realignment funds.  The State then reduces the amount used for this purpose from the monthly realignment apportionment to the County. 
 

Staff recommends approval of this amendment in order for the County to continue to provide acute psychiatric inpatient services to adults with severe mental illness. Yolo County HHSA contracts with three local acute psychiatric inpatient hospitals and the reduction in this contract will allow funds to be shifted to purchase more dedicated beds at local psychiatric health facilities; a service which costs less per day in comparison to acute inpatient care and is claimable to the state for reimbursement. This amendment also adds language for the modification of rates based on regulations for fee setting for these services. See Attachment 1 to Att. A. First Amendment.

Competitive Bid Process
This agreement was sought out by a Sole Source Letter which was approved by the Procurement Manager. This first amendment does not proffer any changes to the scope of services.

No general funds are required by this action. This action reduces the FY2020-21 and FY2021-22 contract budgets by $120,000, for a total reduction of $240,000. The new FY2020-21 contract budget after this reduction is $350,000 and will be funded by State Mental Health Realignment funds.  The amount of $350,000 is included in the HHSA proposed budget for FY2020-21.  The related funding will be included in the requested budget process for future fiscal years.

In no event shall the term of the Agreement extend beyond June 30, 2024 nor shall the total contract maximum exceed the amount of ONE MILLION NINE HUNDRED SEVENTY DOLLARS ($1,970,000), unless otherwise agreed to in writing by the parties and approved by the BOS.
