Reason for Recommended Action/Background
The attached ordinance (Attachment A), if adopted, would expand the role of the local Juvenile Justice Commission (“JJC”) to include authority to act as a local delinquency prevention commission pursuant to Welfare & Institutions Code section 233.  The JJC previously served in this capacity until 2014, when the County ordinance conferring this role was repealed as part of a “clean up” effort relating to inactive or defunct local boards, commissions, and councils. Some members of the JJC have since advocated for restoration of this role, and Chief Fruchtenicht is supportive of their request. Judge Beronio of the Yolo Superior Court (the lead for the JJC) is also supportive.

As shown the table included as Attachment B, under state law a delinquency prevention commission is charged with coordinating on a countywide basis the work of governmental and nongovernmental organizations engaged in activities designed to prevent juvenile delinquency. If the ordinance is adopted, the reconstituted Juvenile Justice and Delinquency Prevention Commission (“JJDPC”) is expected to complement ongoing work of the similarly-named Juvenile Justice Coordinating Council (“JJCC”), created by ordinance earlier this year. The proposed ordinance acknowledges the potential for overlapping roles and directs the JJDPC to defer to the JJCC on matters that are primarily or exclusively within its statutory authority.
