Recommended Action
  1. Find that the parcel of land located along Linden Road in the City of West Sacramento is not required for county use; and
     
  2. Approve and authorize the Chair of the Board of Supervisors to sign a quitclaim deed transferring the subject parcel to the West Sacramento Area Flood Control Agency.

Reason for Recommended Action/Background
The recommended action will transfer to the West Sacramento Area Flood Control Agency (WSAFCA) an approximately 1.88-acre parcel of land for which the County has no current or future use. The property is located within the City of West Sacramento on Linden Road where it connects to the former South River Road (now a part of the Southport Levee Improvement Project). The County acquired the property by grant deed in 1971 and the property appears to have been a part of the County’s road network at the time, and subsequently part of the City’s road network after incorporation of the City in 1987. At the time of the 1971 property transfer to the County, the Yolo County Assessor did not assign an Assessor’s Parcel Number to the property and therefore, it did not show during prior property transfers to the City nor during WSAFCA’s acquisition phase of the Southport Levee Improvement Project. WSAFCA has requested the County quitclaim this property to the benefit of the City for the Southport Levee Improvement Project.  

Government Code Section 25365 allows the Board of Supervisors by a four-fifths vote to find that the property is not required for County use and to do so after publishing notice of its intended action at least one week prior thereto in a newspaper of general circulation published in the County. Notice of this action was published in the Davis Enterprise at least ten days prior to the June 29 Board meeting.

As required per Government Code Section 65402, the Zoning Administrator for the City of West Sacramento has determined that transfer of the property is consistent with the City’s General Plan (Attachment C).  Pursuant to Government Code Section 27281, WSAFCA shall accept the property via a certificate of acceptance or by resolution, evidence of which shall be recorded along with the quitclaim deed. WSAFCA shall provide the Clerk of the Board of Supervisors with a certified copy of the recordation.
