Recommended Action |
Adopt resolution approving procedures for the conduct of mail ballot elections in connection with rate changes conducted pursuant to Article XIII D, Section 6(c) of the California Constitution (Proposition 218) for certain property related services. |

Reason for Recommended Action/Background |
Proposition 218, the "Right to Vote on Taxes Act", was adopted in 1996 and resulted in adding Article XIII D ("Assessment and Property-Related Fee Reform") to the California Constitution. Prop 218 imposes certain requirements before local entities can impose or increase property-related fees. As neither Article XIII D nor the Proposition 218 Omnibus Implementation Act (Government Code section 53750 et seq.) offer specific guidance as to the conduct of mail ballot elections, this action approves the County of Yolo's procedures for conducting mail ballot elections in connection with rate hearings for proposed new or increased utility charges.
