Reason for Recommended Action/Background |
State law requires the Sheriff, "with approval and authorization of the board of supervisors," to enter into a memorandum of understanding with the local superior court relating to security services. (Cal. Gov. Code § 69926(b).) Sheriff Lopez has initiated discussions with the Yolo Superior Court regarding a security services MOU, as the existing MOU expires on July 1, 2019. Anticipated topics of discussion in negotiations include appropriate staffing levels and reimbursement amounts. If an MOU cannot be concluded in a timely manner, staff will advise the Board of the issues in dispute and seek guidance (which may include a formal dispute resolution process described in state law).
As indicated in the fiscal impact information, if current staffing levels are maintained without additional compensation from the Court, the General Fund impact will be about $520,000. |

State law does not require a superior court to fully reimburse the cost of security services provided by a Sheriff. In Yolo County, current staffing and service levels are not fully reimbursed by the Court. Staff will endeavor to avoid an outcome that requires the County to subsidize Court security needs. |
