Recommended Action |
- Adopt the plans and specifications for the construction of In-Vessel Digester – Liquid and Food Processing Area;
- Authorize the Director, Division of Integrated Waste Management to sign the Notice to Contractors;
- Authorize the Division of Integrated Waste Management to advertise for competitive bids;
- Authorize the Director, Division of Integrated Waste Management to execute a construction contract with the lowest responsive bidder, provided the contract amount does not exceed available funds, or to reject all bids; and
- Authorize the Director, Division of Integrated Waste Management to approve all construction change orders, provided the contract amount does not exceed available funds for the project.

These actions will allow the Department to solicit competitive bids, expedite the contract award and promptly proceed with construction.
Background
California has a statewide goal to divert 75 percent of waste from the landfill by 2020. In February 2007, the California Department of Resources Recycling and Recovery (CalRecycle) adopted Strategic Directive (SD) 6.1, which calls for a 50 percent reduction in the amount of organics being disposed in the landfills by 2020. Organic waste makes up approximately one third of the 35 million tons of waste that is currently landfilled in California. To aid in meeting the state wide 75 percent goal, Assembly Bill 1826 was passed in September 2014 requiring businesses, including state agencies, which generate certain amounts of organic waste per week to have organic waste recycling programs on or after April 1, 2016. To meet these goals, the landfill has implemented a three-part strategy: having an organic waste transfer facility, an anaerobic composter facility, and construct an in-vessel digester (liquid digester).
The Division of Integrated Waste Management has designed a liquid digester to further divert organic waste from being disposed of in the landfill and surface impoundments. The in-vessel digester will also generate methane for electricity from the diverted organic waste. The construction of the In-Vessel Digester – Liquid and Food Processing Area is needed to support the operation of the In-Vessel Digester including the In-Vessel Digester - Food Depackaging System. Construction is anticipated to begin in July and be complete in September 2019.
This project was previously approved by the Board of Supervisors on July 24, 2018; however, an improved concrete slab to support a large liquid food waste tank and an improved pushwall for food waste loading were added to the construction project. Additionally, unit costs for concrete have increased considerably. These infrastructure design improvements and unit cost increases resulted in an increase in the cost estimate from $850,000 to $1,324,000. Including 15% contingency, this results in a total of $1,523,400. |

Competitive Bid Process |
Project will be advertised on Bidsync.com for competitive bidding. The competitive bid process will be completed in accordance with State law. Bids will be opened and read publicly at the Department of Community Services-Division of Integrated Waste Management. A contract may only be awarded to the lowest responsive and responsible bidder. |

In-Vessel Digester – Liquid and Food Processing Area will be paid by the Sanitation Enterprise Fund, which is funded through the tipping fees collected at the landfill. There will not be an impact to the general fund. The total budgeted amount for FY 19-20 for construction of the In-Vessel Digester including contingency is $3,000,000. The engineer's estimate including contingency for construction of the In-Vessel Digester – Liquid and Food Processing Area is $1,523,400. Funding for this item is included in the requested budget for FY 19-20.
