Recommended Action
Adopt resolution approving guidelines for the submission and tabulation of Proposition 218 protests in connection with rate hearings conducted pursuant to Article XIII D, Section 6 of the California Constitution.

Reason for Recommended Action/Background
Proposition 218, the "Right to Vote on Taxes Act" was adopted in 1996 and resulted in adding article XIII D ("Assessment and Property-Related Fee Reform") to the California Constitution. While Prop 218 imposes certain requirements before local entities can increase property-related fees and assessments, it provides little guidance and few requirements for the procedure to protest increased charges. As such, it is advisable for rate-making agencies to establish such rules. This action approves the County of Yolo's guidelines for considering protests to certain proposed increases to utility charges (Attachment A).
