Reason for Recommended Action/Background |
As the Board is aware, the County is legally obligated to provide legal representation for indigent defendants in criminal actions when the Public Defender is unable (typically because of a conflict of interest) to provide representation. The County contracts with local attorneys that serve on a Conflict Indigent Defense Panel for this purpose.
This item proposes to extend the existing contracts with seven attorneys that serve on the Conflict Indigent Defense Panel for an additional year (through June 30, 2020). The proposed contract amendment would also provide a 2.5% compensation increase during the extended term. This increase is consistent with the annual incremental increases included in the existing three-year agreements approved for each attorney on May 31, 2016. County Counsel expects to complete a competitive solicitation process for conflict indigent defense work prior to the June 30, 2020 expiration date of the extended agreements.
A template for the agreement amendment is attached to this Board item. The template will be customized for each attorney serving on the Panel if the Board approves the recommended action. |

The proposed 2.5% increase in compensation will be included in the proposed budget for the Conflict Indigent Defense Panel for the 2019-20 fiscal year. If this funding is not approved as part of the upcoming budget item, the contracts can be amended or terminated. |
