Recommended Action
  1. Approve agreement with Twining, Inc. in the amount of $400,000 for a term of five years to provide on-call construction materials testing, road structure evaluation, and geotechnical engineering services for various projects for the Public Works Division; and
     
  2. Delegate authority to the Director of Public Works to sign the agreement and to negotiate, sign and execute any additional forms, documents and/or amendments that do not increase the agreement term or maximum compensation, as necessary relating to this agreement.

Reason for Recommended Action/Background
Yolo County does not have the necessary equipment or expertise in-house to do construction materials laboratory testing, road structure evaluation and geotechnical engineering design. It is necessary for the County to contract with consultants who will provide these services “on call” so that we may fulfill our Quality Assurance Program commitment.
 
Approval of this agreement will allow for the Public Works Division to obtain on-call field and laboratory materials testing, existing road structure evaluation, and other geotechnical engineering and services for county road and bridge projects through April 22, 2024. Staff has negotiated a contract with a second firm, but Caltrans has not finished their financial review so approval of that contract will come to the Board at a later date.  By contracting with more than one firm to provide these services, projects can be pursued more efficiently using the firm with the best and most available resources for the individual project, without the need for a new time-consuming and costly request for proposals process.  This contract will allow a quick response on an as-needed basis for future projects.

Competitive Bid Process
A request for qualifications (RFQ) for On-Call Material Testing, Road Evaluation and Geotechnical Design Services was advertised on Bidsync, beginning February 1, 2019.  A notice of the RFQ advertisement was also emailed directly to eleven Northern California firms known to be experts in providing these services.  A total of ten firms responded and nine Statements of Qualifications (SOQs) were accepted; one SOQ was rejected because it was not submitted prior to the 3:00 pm February 26, 2019 deadline.  A selection committee of three public works staff engineers reviewed all the proposals and conducted interviews with the top four most qualified consultants.  The committee ranked Twining Inc. and Engeo, Inc. as the two most qualified consultants having provided the highest ranked proposal, interview, and reference checks.  Staff negotiated a contract with Twinning, Inc. in accordance with the process required for consultant contracts that are funded with federal transportation funds.

The not-to-exceed cost for this on-call contract over the five-year term is $400,000. The costs will be budgeted as part of the various projects funded with state, federal, and road fund money. Project funds will be included in the recommended annual budgets. Federally funded transportation projects will be reimbursed at rates between 88.53% and 100% with a local road fund match of 0% to 11.47%.
