Reason for Recommended Action/Background
For many years there have been on-going issues between OHV riders and land owners within Yolo County. Complaints from land owners related to OHV riders trespassing and vandalizing private property continue to be received. In the areas where most problems have occurred, land owners have gone to great lengths to prevent riders from entering their property; however, OHV riders have continued to break through the physical barriers, gates and fencing to access those areas. Other areas of concern are habitat restoration sites along Putah and Cache Creek. 

In addition to trespassing, there also arises the problem of patrol deputies not being equipped to respond to an incident. The area where most off highway vehicle use occurs is both rugged and rural, and therefore cannot be accessed by traditional patrol vehicles.  To help augment enforcement efforts, the Yolo County Sheriff's Office first sought OHV grant revenue funding in FY 2009/10 and in subsequent fiscal years. This funding has allowed the department to purchase equipment and resources, and attend specific training needed to help establish an enforcement team, to better serve landowners negatively affected by OHV riders.  With this training and equipment we have also been able to provide OHV educational opportunities to the citizens of Yolo County who wish to know more about OHV programs and recreation.  In FY 2015/16, the Board of Supervisors enacted a nighttime ban on OHV activity in Cache Creek, providing contingency funds to cover the increased enforcement activity that the ban required.      

For FY 2019/20, state funding is being pursued in order to continue the program. This year the Sheriff's Office has chosen to pursue additional funding by submitting an application for an Education and Safety grant in addition to the Law Enforcement grant we have historically received. Approval of the Board of Supervisors is required for the applications to indicate we will accept the funds if awarded and agree to all terms and conditions of the grants. If awarded, the Education and Safety grant funds will allow us to install an informational kiosk at the public access point along Putah Creek, and purchase ATVs to allow for pre-staging for quicker response times to search and rescue missions. Total funds requested for the Education and Safety OHV grant are $40,059. A 33% match of $14,075 is required.

The Law Enforcement OHV grant Funds will be used for overtime costs, expenses related to OHV equipment use, and OHV-specific training. If the full amount of the requested state funding is received, one-time costs will include the purchase of motorcycles and a side by side vehicle to replace aged equipment that has needed increased maintenance, and therefore increased expenditures on repairs.  We are also requesting the purchase of a Jeep Rubicon which will allow us to perform patrol duties in OHV riding areas when conditions are too adverse to use our current open air patrol vehicles.  Total funds requested for the Law Enforcement OHV grant are $330,387. A 33% match of $110,129 is required.

The Yolo County Sheriff's Office has been and will continue to work in cooperation with other departments within the county such as the Parks Division of General Services and the Community Services department to help develop long-term solutions to these issues. County Counsel has approved the resolution as to form.

The total of the two grant applications is $494,651. The state requires a 33% ($124,204) local match, which in previous fiscal years was partially met with funds received from the Natural Resources Division. The remaining program balance of $370,447 will come from this state grant.

Remaining funding needed for the $124,204 local match will be met with In-Lieu Gas Tax Funds, although additional funding from Natural Resources may be available. These In-Lieu Gas Tax Funds are generated from registration fees paid by off highway vehicle riders and are for use by local agencies to regulate off highway vehicle programs, including enforcement efforts. As done in previous years, the Sheriff's Office plans to request assistance with the matching funds from the Natural Resources Division, in addition to the In-Lieu Gas Tax funds.The requested grant funds will be used to finance Salary and Benefits, and Services and Supplies in the Patrol Budget Unit, supporting patrol activity along the Putah and Cache Creek recreational areas and OHV educational outreach. 

If awarded, the total program amount will be included in the 2019-20 recommended budget.
