Hold public hearing to consider adoption of General Plan Amendment 2019-01 to update two elements of the Countywide General Plan: the Health and Safety Element, to incorporate the 2018 Multi-Jurisdictional Hazard Mitigation Plan Update; and the Land Use and Community Character Element, to adopt the 2019 Esparto Community Plan, and change the General Plan Land Use designation on a portion of Yolo County Assessor's Parcel Number 042-340-004 to implement the Bryte Landfill Remediation Project. Recommended Action
  1. Hold a public hearing;
     
  2. Adopt Resolution (Attachment A) regarding a General Plan Amendment to update two elements of the Countywide General Plan, in accordance with the California Environmental Quality Act (CEQA), including a Negative Declaration prepared for the 2019 Esparto Community Plan (Attachment C);
     
  3. Approve General Plan Amendment 2019-01 shown in Attachment E, including resolution to adopt 2019 Esparto Community Plan shown in Attachment G; and
     
  4. Adopt the Ordinance shown in Attachment I, which will:
     
    1. Amend the Health and Safety Element to incorporate the 2018 Multi-Jurisdictional Hazard Mitigation Plan Update and make revisions to text and
       
    2. Amend the Land Use and Community Character Element and General Plan Land Use Map to:
       
      1. Rescind the 2007 Town of Esparto General Plan and approve the Findings to adopt the 2019 Esparto Community Plan, and redesignate several properties in the community of Esparto (Attachment J); and
         
      2. Redesignate approximately 16 acres of Assessor's Parcel Number 042-340-004 (portion of) from AG to PQ with a corresponding rezone from Agricultural Intensive (A-N) to Public/Quasi-Public (PQP) in accordance with the General Plan land use designation change.

Reason for Recommended Action/Background
The proposed actions to adopt General Plan Amendment (GPA) 2019-01 consist of a series of changes that will update the Countywide General Plan in accordance with state law, and regulations providing for general plan and community plan consistency; provide for land use and zoning consistency; and, protect public health, safety and welfare. Government Code Section 65358 allows for annual amendments of a General Plan so long as no mandatory element is amended more than four times during any calendar year; each amendment may include more than one change to the General Plan.

The 2030 Countywide General Plan was last amended in May 2018 to revise the Land Use and Community Character Element (and General Plan Land Use Map) and Public Facilities and Services Element. The currently proposed GPA, the first of 2019, proposes amendments to the Land Use and Community Character Element, including the General Plan Land Use Map, and Health and Safety Element, which are shown in Attachment E.  Land Use and Safety Elements are mandatory elements of a General Plan.

HEALTH AND SAFETY ELEMENT
The Health and Safety Element is proposed to be amended to incorporate the previously adopted 2018 Multi-Jurisdictional Hazard Mitigation Plan in accordance with state law, which requires Safety Elements to be reviewed and updated upon adoption of the next revision of a local hazard mitigation plan. Resolution No. 18-139 was adopted by the Board on November 6, 2018, approving the Yolo County Operational Area Multi-Jurisdictional Hazard Mitigation Plan Update (Attachment F). Text revisions, shown in Attachment E, have been added to the Health and Safety Element to address the requirement for updates in order to remain eligible for hazard mitigation grant funding assistance.

LAND USE AND COMMUNITY CHARACTER ELEMENT
The Land Use and Community Character Element is proposed to be amended to rescind the 2007 Town of Esparto General Plan and adopt the 2019 Esparto Community Plan in accordance with Community Character Policy CC-3.2 that requires an update to Area General Plans in the form of new or updated Area Community Plans (Attachment H). The updated Esparto Community Plan also includes changes to the General Plan Land Use and Zoning Maps to implement goals and policies that seek to protect property and natural resources, provide for a better land use balance between residential and job-producing uses, facilitate economic development, and focus higher residential density and commercial uses at the town's center.

Notable changes in the updated community plan include redefining the Urban Growth Boundary to eliminate flood hazard areas from urban development, eliminating the Downtown Mixed Use (DMX) zoning on parcels in the town to increase the potential for commercial development, and increasing residential density at the town center to allow for a more affordable range of housing. Approximately 153 parcels are proposed to be re-designated to implement the 2019 Esparto Community Plan, as shown in Attachment H.  Property owners whose parcels are proposed to be re-designated were notified and attended community and/or Planning Commission meetings.

Planning staff met regularly with the Esparto Citizens Advisory Committee and members of the community for well over a year to update the Esparto Community Plan. A public workshop was also held with the Planning Commission in September 2018 to accept feedback from the public and recommendations from the commission. Additionally, staff coordinated with the Yocha Dehe Wintun Nation on proposed changes to some of the land use goals and polices regarding commercial development, as well as updating some of the region's historical information. The Planning Commission held a public hearing on February 14, 2019, and unanimously recommended approval of the 2019 Esparto Community Plan with a recommendation to modify the urban growth boundary line on the land use map to follow the FEMA flood zone contours. Staff concurs with this recommended modification. The Planning Commission staff reports for the September 13, 2018, public workshop and February 14, 2019, public hearing regarding a recommendation to the Board are attached for reference in Attachment K. 

The Countywide General Plan Land Use Map and County Zoning Map are also proposed to be amended to implement the Bryte Landfill Remediation Project and comply with mitigation previously adopted for the project. A Mitigated Negative Declaration (MND) and Mitigation Monitoring and Reporting Program (MMRP) were prepared and adopted for the project by the Sacramento Area Flood Control Agency (SAFCA), and subsequently adopted by the Board as a Responsible Agency (Attachment D). The MND and MMRP require that, prior to initiation of construction, SAFCA shall submit an application to Yolo County to rezone the Corrective Action Management Unit (CAMU) site from agricultural zoning to a designation more compatible with emplacement of treated landfill material and associated facilities. Construction is not to begin until the new zoning designation has been approved by Yolo County. Thus, a General Plan land use designation change from Agriculture (AG) to Public/Quasi-public (PQ), and subsequent rezone from Agricultural Intensive (A-N) to Public/Quasi-public (PQP), is proposed on approximately 16 acres of Assessor's Parcel Number (APN) 042-340-002 to comply with mitigation described in the MND and to facilitate the relocation and mediation of the Old Bryte Landfill after SAFCA has acquired the property (Attachment E). A public hearing was held at the Planning Commission on March 14, 2019, to consider re-designation at the proposed CAMU site; the Commissioners unanimously recommended the Board (1) reaffirm adoption of the MND and MMRP prepared for the Bryte Landfill Remediation Project, and (2) approve a General Plan land use designation change and rezone to support the remediation and relocation of the Old Bryte Landfill.
