Recommended Action
  1. Adopt a resolution to summarily vacate a portion of County Road 43 right-of-way on Assessor’s Parcel Numbers 060-210-009 and 060-210-011 in Capay Valley; and
     
  2. Authorize the Clerk of the Board of Supervisors to record a certified copy of the adopted resolution.

Reason for Recommended Action/Background
Yolo County is looking to abandon a portion of County Road 43 (Attachment A) which is no longer needed for use by the County. The right-of-way for the proposed abandonment is a 40 foot wide strip of land at the eastern terminus of County Road 43 that is surrounded by the same ownership, (essentially making it a private driveway) and does not provide public access to Cache Creek. The proposed abandonment is identical to the right-of-way recorded for the road shown as “Vale Avenue” on the Tract Map entitled "Map of the Cashmere Colony Tract" recorded in Map Book 1, at Page 11 in the Office of the Recorder of Yolo County, California.
 
Currently there are two parcels affected by the proposed vacation which are both under the ownership of Muller-Rivers who also owns Full Belly Farms. County staff met with Mr. Muller to discuss the abandonment and obtained concurrence prior to proceeding with the summary vacation. The California Streets and Highways Code Section 8334 allows the Board of Supervisors to summarily vacate “a portion of a street or highway that lies within property under one ownership and that does not continue through such ownership or end touching property of another.” See Attachment B for the resolution to vacate this road right-of-way.
 
Staff has concluded that this action is exempt from the California Environmental Quality Act (CEQA) (Attachment C). Section 15061 (b)(3) of the CEQA Guidelines allows for a lead agency to determine whether a project is exempt from CEQA based on the general rule that CEQA only applies to projects which have the potential for causing a significant effect on the environment.
