Reason for Recommended Action/Background
The Board of Supervisors approved 98 On-Call Consulting contracts on May 9, 2017. When approved, the Board stipulated that any project that is awarded to an on-call consultant is subject to a review process that, depending on the size of the contract, may include the County Procurement Agent, the County Administrator's Office, or the Board of Supervisors.

In compliance with the County Administrative Policies and Procedures Manual, all projects awarded that are over $100,000 or any grant-funded work will be brought to the Board of Supervisors for approval. The on-call consultant contracts may be utilized for work on a non-emergency basis, but that does not preclude the County from seeking other firms on the basis of requests for qualifications for any other major project.

The proposed project associated with this work authorization – Teichert Shifler Mining and Reclamation Project – includes a request for a General Plan Amendment (GPA) (see additional application detail below).  Yolo County Code requires that a GPA proposed by a private party must first be authorized for further study by the Board of Supervisors following a public hearing.  The Board of Supervisors approved the authorization for further study of the General Plan Amendment, rezoning, and associated entitlements for the proposed project on December 16, 2014.

In September 2018, the Yolo County Planning Division received the formal application for the Teichert Shifler Mining and Reclamation project. In this application, Teichert Materials is requesting the approval of a new 30-year mining permit and reclamation plan to mine aggregate (rock, sand, and gravel) on approximately 277 acres of a 319-acre agriculturally-zoned property for the purpose of supplying aggregate material to the existing Teichert Woodland aggregate processing facility.

The project site, known as the Shifler Property, is located approximately three miles west of the City of Woodland, in unincorporated Yolo County. It is generally bounded by County Road 94B to the west, Cache Creek to the north, and County Road 22 to the south. It is proposed that, at the conclusion of mining, the mined land will be reclaimed to agriculture and a mix of habitat uses, including lake, grassland, riparian woodland, and native landscape.

The project application includes a request for a Development Agreement, and a General Plan Amendment (GPA) to apply the Mineral Resource Overlay (MRO) over the project site, and a rezoning to apply the Sand and Gravel Overlay (SG-O) over the Agricultural Intensive (A-N) base zoning. A GPA is also required to include the project site in the Off-Channel Mining Plan (OCMP), and a Flood Hazard Development Permit would be required for any mining activities that occur within 700 feet of the bank of Cache Creek.

Staff members from the County's Planning and Natural Resources Divisions will be undertaking a comprehensive analysis of this application to ensure compliance with the County's Cache Creek Area Plan, General Plan, zoning regulations, California Surface Mining and Reclamation Act, and California Environmental Quality Act. An environmental impact report will also be prepared and circulated for public and agency review. This work authorization in the amount of $150,500 (Attachment A) would allow Tschudin Consulting Group to support Yolo County staff during the processing of this application. Duties to be performed by Tschudin Consulting, as outlined in the Scope of Work (Attachment B), through this work authorization include, but are not limited to:
  • Providing professional project management oversight and advice for the work effort necessary to see the project to conclusion.
  • Overseeing and guiding consultant preparation of environmental analysis and other technical reports that may be necessary.
  • Assisting County's Senior Mining Planner in developing, adjusting, and adhering to project schedule and work plan.
  • Assisting with coordination between County's Planning Division, County's Natural Resources Division, applicant, various agency representatives, and members of the public.
  • Overseeing and advising County staff regarding preparation of appropriate correspondence and staff reports.
All costs associated with this work authorization, as well as all staff time spent on processing the application, are reimbursable through the fees paid by the applicant, Teichert Materials, to the Planning Division, as agreed upon in the Permit Processing Fee Agreement (Attachment C).

Competitive Bid Process
The Natural Resources Division requested quotes from three approved vendors, under the Environmental Planning category, on the General Services Department's on-call contract list. Tschudin Consulting was the only vendor contacted who was able to submit a price. One vendor declined to submit due to work capacity limitations and the other vendor was unresponsive.

Staff found that the price of this work authorization is reasonable when compared to previous contracts issued by the County for the processing of the two most recent mining permit application projects – Teichert Schwarzgruber and Granite Esparto. Of these two recent projects, the Teichert Shifler application is most similar and comparable to the Granite Esparto application when comparing the project sizes, lengths of proposed mining periods, and anticipated level of environmental review and public engagement. The contract budget for assistance with processing the Granite Esparto application was approximately $190,000. Conversely, the contract budget for assistance with processing of the Teichert Schwarzgruber application, which is a smaller site, has a shorter mining period, and simpler environmental review when compared to Teichert Shifler, was $95,000.

On-Call Contracts were solicited and reviewed in compliance with all Department of Financial Services polices and procedures. Contracts were approved by the Board of Supervisors in May 2017. The Procurement Division has been involved with the solicitation process.
