Recommended Action
  1. Approve second amendment to Agreement No. 16-34 with Consor North America, Inc.(Consor) to extend the term of the agreement through February 23, 2027, for the County Road (CR) 29 Bridge Replacement over Dry Slough; and 
     
  2. Authorize the Chair of the Board of Supervisors to sign the second amendment.

Reason for Recommended Action/Background
Approval of the agreement amendment will allow Consor to complete final plans and specifications for the County Road (CR) 29 Bridge Replacement over Dry Slough after completion of the right of way phase.

Background

On February 23, 2016, the Board of Supervisors approved an agreement with Consor for bridge design and environmental services for two County bridge projects, CR 29 Bridge Replacement over Dry Slough and CR 95 Bridge Replacement over Dry Slough.

The consultant's work for the CR 95 Bridge Replacement over Dry Slough concluded after the bridge construction was completed in November 2020.

The CR 29 Bridge over Dry Slough (Bridge No. 22C-117) is located approximately 0.75-mile west of the intersection with CR 98.  The existing 20-foot-wide bridge will be replaced with a 32-foot-wide bridge comprised of two twelve-foot lanes and four-foot shoulders.

The right of way acquisition for the CR 29 bridge project has been more complicated than other projects due to the existing Farmland Conservation Easement recorded on the property along the south side of the bridge.  Since the easement was purchased with Natural Resources Conservation Service (NRCS) funds, NRCS holds an interest in the easement which restricts the methods in which compensation for adjustments to the Farmland Conservation Easement can occur. 

The County has been working with the easement owners (the Yolo Land Trust, and the City of Davis) for the past year to determine a compensation method acceptable to the NRCS.  County staff presented several compensation methods for consideration, but none were accepted by NRCS.  As a result, the County is presently working on acquiring a replacement Farmland Conservation Easement to compensate for the project impacts (0.164 acre replacement) to the existing agricultural conservation easement, which is acceptable to NRCS.

The unexpected time that has been needed to address impacts to the Farmland Conservation Easement has delayed completion of the project design.  The amendment would extend the agreement term end date to February 23, 2027.  This extension should provide enough time for Consor to complete final plans and specifications (following conclusion of the above-described easement mitigation efforts), and to assist the county as necessary during the construction phase. This amendment does not include a cost increase. County staff is satisfied with the contractor's performance to date and has no concerns with the Contractor's continued work per the recommended amendment.
