RECOMMENDED ACTION
That the Planning Commission:
  1. Receive a staff presentation and take public comment;
  2. Determine that the WSAFCA Southport Borrow One mining project and associated reclamation is complete, and the mined lands have been reclaimed in accordance with the approved Reclamation Plan for the site; and
  3. Make a determination that the Financial Assurances ($1,101,055.00 Budget Set Aside, WSAFCA Budget Resolution 17-03-01) may be released.
REASONS FOR RECOMMENDED ACTIONS/BACKGROUND
The WSAFCA Southport Borrow One Project site is located east of Jefferson Boulevard immediately adjacent to and south of the City limits of West Sacramento, east of the Deep Water Ship Channel, and West of the Sacramento River  (Attachment A).  The project (ZF #2016-0020) was presented to and approved by the Planning Commission on January 19, 2017 (Attachment B).  The applicant requested approval of an Agricultural Surface Mining Permit and Flood Hazard Development Permit to excavate approximately 300,000 cubic yards of soil that would be transported and used to construct sections of the levee embankment for the Southport Sacramento Early Implementation Project in the City of West Sacramento.  The project site, referred to as the Borrow One site, is approximately 114 acres and has a zoning designation of Agricultural Intensive/Clarksburg Agricultural District Overlay (A-N/CADO). 

During the course of excavation at the site, it was determined that the amount of earthen material required for levee maintenance and reconstruction did not require the amount of material originally estimated; therefore, only the agricultural pond area (approximately 25.5 acres) was excavated.  No excavation of the agricultural area (approximately 68 acres) was required or undertaken.  This allowed the agricultural area to remain in row crops during excavation, as it is currently.  Approximately 90,000 cubic yards of material was excavated from the pond site at the northeast corner of the site, to a depth of between two and five feet.  The sloped areas adjacent to the pond are graded, and revegetated with native grasses (Attachment C).  Staff from the County's Natural Resources Division has been advised by the applicant that all mining (excavation) and reclamation activities at the site are complete.  Following this notification, Natural Resources Division Staff conducted an inspection of the site on October 1, 2019, and submitted required inspection reports to the State Division of Mine Reclamation (DMR).

On December 23, 2019, Natural Resources Division staff and DMR staff inspected the WSAFCA Southport Borrow One mining site, and have confirmed that the project is complete, and the site has been reclaimed in accordance with the approved reclamation plan.  On January 16, 2020, the Natural Resources Division received a letter from DMR, concurring that mining and reclamation at the site are complete, and that financial assurances may be released (Attachment D).

The County's Agricultural Surface Mining and Reclamation Ordinance (County Code Section 10-8.1201) and the Surface Mining Reclamation Ordinance (Section 10-5.711), require that the release of financial surety be placed on the agenda of the Planning Commission once it has been determined that reclamation has been completed as approved. 
COLLABORATIONS
The County Administrator's Office Natural Resources Division staff collaborated with the Department of Community Services (Planning Division staff), and the State of California Department of Conservation's Division of Mine Reclamation.
APPEALS
Any person who is dissatisfied with the decisions of this Planning Commission may appeal to the Board of Supervisors by filing with the Clerk of the Board of Supervisors within fifteen (15) days from the date of the action. A written notice of appeal specifying the grounds for appeal and an appeal fee immediately payable to the Clerk of the Board must be submitted at the time of filing. The Board of Supervisors may sustain, modify, or overrule this decision.
