Reason for Recommended Action/Background
Yolo County, through the Sheriff’s Office Animal Services Section, is contractually responsible for providing all cities, unincorporated areas, and the campus of UCD with animal control ordinance enforcement, dog licensing, shelter operation and spay/neuter education services. In the past fiscal years, the Sheriff’s Office has contracted with the City of Davis, City of West Sacramento, City of Winters, City of Woodland, and the University of California, Davis (UCD) to receive reimbursement of such services. The Sheriff’s Office requests Board approval for four of the five Agreements.  The City of Winters will send their Agreement to their City Council for approval on December 17, 2019 and the Sheriff’s Office will request approval from the Board at later date.  The term of the proposed four agreements with each jurisdiction is from July 1, 2019 through June 30, 2020 with all agreements totaling $1,806,312 as detailed in the table below.

The Sheriff’s Office will provide:
  • The pickup of stray animals not in the presence of their owners that may be injured or sick and require the provision of medical care per Penal Code section 597(f).
  • The provision of rabies control including quarantine of biting animals and the pickup of high risk rabies animals for testing, per Health and Safety Code sections 120210-121690.
  • Assistance to the Yolo County Coroner, fire departments, or other law enforcement agencies.
  • Response to vicious animals.
  • Response to contained stray or free roaming dogs
  • The receiving and forwarding of Animal Complaint Reports to the appropriate jurisdiction
  • Response to wildlife only if there is a bat, skunk, or rabies control issue.
Services shall be limited to 8:00 a.m. to 5:00 p.m., Monday through Saturday. Services will be provided outside these specific hours only when authorized in advance by a representative of the requesting city or UCD, except for when required by Health and Safety Code section 121595 and 121600 or Penal Code section 597(f). In addition to the agreed compensation amounts, an additional hourly fee of $44.00 per hour will be reimbursed by the cities or UCD for any extraordinary incident defined as requiring a response time of more than ten County staff hours.
 
Total program cost to the cities and UCD is based on the adopted fiscal year 2019-20 Animal Services budget. The cost is allocated between the cities of Davis, West Sacramento, Winters, Woodland, UCD, and Yolo County based on a three-year averages of the number of animals housed and number of calls for service. A reduction of the costs for each jurisdiction is based on the three-year average of animal licenses sold. The representatives of the cities and the University mutually agreed that the program should be funded based such parameters to smooth out any drastic changes to patrol calls, animals housed, and /or licenses sold from year to year. As a result, net program costs are recovered through these revenue agreements, with Yolo County only responsible for the portion of costs associated with animal shelter and patrol services provided to the unincorporated areas of the county.
 
Previously these revenue agreements have had a two-year term, however, the Sheriff’s Office has decided on a one-year term to better forecast future costs. The Sheriff’s Office continues to work with the participating agencies to look at every option possible to reduce the operating expenditures, increase revenues, and enhance the services provided by the Animal Services Section.  In an effort to increase licensing compliance and reduce agreement amounts, an agreement provision has been made that, should the revenue collected from licensing within each city's jurisdiction exceed the anticipated fiscal year amount, the final quarter payment due to the County will be adjusted accordingly.  The participating agencies have agreed to take a more active role in reducing service calls after hours, which has been in effect for several fiscal years.  Also, a pilot program to augment services in the city of Davis has been implemented.

Because these agreements are between government entities, Board of Supervisors approval is now requested.

County Counsel has approved the attached agreements and approved as to form. The County Administrator provides oversight in reaching concurrence with the participating cities and UCD on the calculation of each entity’s portioned cost of the program’s $3,079,857 budget. Sheriff-Coroner staff has historically collaborated with each jurisdiction in reaching the methodology to prorate the program’s costs.

The 2019-20 Animal Services current adopted budget appropriation of $1,867,219 for Law Enforcement Services includes the cumulative amount of $ $1,806,312 in reimbursement revenue from the city and University agreements">. The general fund amount of $553,938 for FY 2019-20 Yolo County portion was included in the adopted budget, therefore no additional general funds will be required.
