In 1975, as part of the development of El Macero, the developer Mace Properties, Inc. (“MPI”) dedicated “Lot A” in Subdivision No. 2388, El Macero Unit No. 4, filed April 17, 1976, in Book 9 of Maps, Pages 36, 37 and 38 and is also reflected in Subdivision No. 1086, El Macero Unit No. 2, filed in Book 7 of Maps, Pages 26 and 27 , Parcel No. 068-192-017-000 (“Property”) to the County “for public use as a part of the Domestic water supply system.” The County accepted the dedication on April 26, 1975, by Resolution No. 75-49, thereby creating a fee simple subject to a condition subsequent with the County, with a power of termination in MPI.
The Property is not currently used for public purposes by either the County or the El Macero County Service Area, and there are no plans for its future use, whereas the successors-in-interest to MPI wish to explore beneficial uses of the property that could benefit the community. Accordingly, staff recommends that the Board adopt the attached resolution to find that its ownership in the Property has terminated, and disclaim any ownership in the Property. As a result, ownership in the property will automatically revert back to MPI or its successors-in-interest. |
